HOUSE BILL NO. 5335

A bill to amend 1954 PA 116, entitled

"Michigan election law,"

by amending section 735 (MCL 168.735), as amended by 2004 PA 92, and by adding section 730b.

the people of the state of michigan enact:

Sec. 730b. (1) The clerk of each city or township must provide to each challenger in a precinct or absent voter counting board in that city or township a visible identification badge that includes the word "challenger". The identification badge may include a reference to the precinct location or precinct number, but must not include any of the following information:

(a) The name of the challenger.

(b) The name of a political party or the logo of a political party.

(c) Any other identifying mark or word that is not otherwise authorized under this subsection.

(2) At all times while serving as a challenger in a precinct or absent voter counting board, an individual must do both of the following:

(a) Wear the identification badge provided by the city or township clerk.

(b) Carry his or her certificate of completion for election challenger training as provided in section 730a.

(3) Upon arriving at a precinct or absent voter counting board, a challenger must immediately check in with the election inspector chairperson for that precinct or absent voter counting board and provide his or her identification badge and certificate of completion for election challenger training. When leaving a precinct or absent voter counting board, a challenger must notify the election inspector chairperson and return the identification badge provided by the city or township clerk.

Sec. 735. (1) At each primary and election, election inspectors shall keep 1 poll book and 1 poll list. An election inspector shall enter in the poll book, in the order in which electors are given ballots, the name of each elector who is given a ballot and immediately after the name, on the same line, shall enter the number of the ballot given to the elector. For an absent voter ballot, when an election inspector removes the ballot from the sealed absent voter envelope, the election inspector shall enter in the poll book the name of the absent voter and the number of the ballot.

(2) If an elector is issued a provisional ballot, an election inspector shall enter a proper designation in the poll book, including whether the provisional ballot was tabulated in the precinct or was secured for verification after the election.

(3) Upon the arrival or departure of any challenger, an election inspector must enter the name of the challenger and the time of his or her arrival or departure in the poll book.

(4) If a challenge is made by a challenger, an election inspector must enter that challenge in the poll book and include how the challenge was resolved. If a challenge was rejected, an election inspector must note in the poll book why the challenge was rejected.

(5) (3) At the completion of the precinct canvass, an election inspector shall must record on the certificate provided in the poll book the number of each metal seal used to seal voting equipment and ballot containers. Each member of the board of election inspectors shall must sign the certificate.

Enacting section 1. This amendatory act does not take effect unless House Bill No. 4528 of the 101st Legislature is enacted into law.
