Good and gracious God, giver of all good gifts, we thank You for the many ways You have blessed this state and this legislative body. As You once again work the spring miracle of resurrecting nature through our beautiful Michigan, keep us ever mindful that we are entrusted with the lives of those millions of our citizens who worship You as Father. Help this legislature to feel the partnership they share with You. Help them to see this world with Your eyes and to act with a prophets courage. Give our democracy the strength of two wise political parties, but never allow our partisanship to subvert the common good. We are taught that the greatest in Heaven are those who serve the needs of all. Give to these public servants a true sense of the nobility of their call. We give You praise, we give You thanks and we ask You for Your strength. Amen.

The Michigan Jobs Commission will shortly be announcing statewide the distribution of the Summer Youth Employment and Training Program funding which we receive through the federal Job Training Partnership Act. As you may know, in Michigan all federal job training dollars are awarded through our workforce development system.
For your reference, I am attaching the statewide list of Michigan Works! Agencies. Please coordinate with your local Michigan Works! agency if you would like to do a press release prior to the attached announcement from the Michigan Jobs Commission.

West Central Michigan Employment and Training Consortium
March 31, 1997
On behalf of the West Central Michigan Workforce Development Board (WDB) and Local Elected Officials (LEO), it is my pleasure to share this initial summary of Job Training Plans with you. This summary updates funding expected to be available from the federal Job Training Partnership Act for a range of programs operated in the West Central area.
As you know, local Workforce Development Boards (WDB) and Local Elected Officials (LEO) are working with a variety of partners on the development of an Integrated "No Wrong Door" delivery system to be operated under the statewide Michigan Works! name. Michigan Works! West Central covers the five county area which includes Lake, Mason, Mecosta, Newaygo, and Osceola counties.
All programs will be operated from July 1, 1997 through June 30, 1998, with the exception of the JTPA Title IIB Summer Youth Employment and Training Program with operational dates from when school is out for the summer until September 30, 1997. Work in preparation for this program has already begun.
The Title II activities serve economically disadvantaged youth and adults with a variety of training activities, from basic training, to skill training in a school and training with a private business. Title III activities serve dislocated workers, those who have lost their jobs due to a permanent layoff or the closing of a business.
As part of the ongoing development of the Michigan Works! system, Request for Proposals (RFP) have been issued soliciting bidders for these programs and activities. The WDB/LEO have determined all adult activities will be operated together, and all youth activities will be operated together on not less than a county basis. This will keep services unified in operation and easily identified by job seeking and employer customers of the system in each county.

Transportation Needs Study Committee
Citizens Advisory Committee
State Transportation Commission
Michigan Department of Transportation
 
Executive Reorganization
 
Whereas, Article V, Section 2, of the Constitution of the State of Michigan of 1963 empowers the Governor to make changes in the organization of the Executive Branch or in the assignment of functions among its units which he considers necessary for efficient administration; and
Whereas, the transportation needs study committee was created by Section 9a of Act No. 234 of the Public Acts of 1987, being Section 247.659a of the Michigan Compiled Laws; and
Whereas, the transportation needs study committee was to report to the Governor, the state transportation commission and the legislature on various transportation needs of the state; and
Whereas, no Governor has appointed members to the transportation needs study committee since its inception in 1987; and
Whereas, the state transportation commission was created by Article V, Section 28, of the Constitution of the State of Michigan of 1963 to "establish policy for the state transportation department transportation programs and facilities, and such other public works of the state, as provided by law;" and
Whereas, the functions, duties and responsibilities assigned to the transportation needs study committee can be more effectively and appropriately organized and carried out by the state transportation commission; and
Whereas, a citizens advisory committee was created by Section 9a of Act No. 234 of the Public Acts of 1987, being Section 247.659a of the Michigan Compiled Laws; and
Whereas, the functions, duties and responsibilities assigned to the citizens advisory committee can be more effectively organized and carried out by the Director of the Department of Transportation; and
Whereas, it is necessary in the interests of efficient administration and effectiveness of government to effect changes in the organization of the Executive Branch of government.
Now, Therefore, I, John Engler, Governor of the State of Michigan, pursuant to the powers vested in me by the Constitution of the State of Michigan of 1963 and the laws of the State of Michigan, do hereby order the following:
1. All the statutory authority, powers, duties, functions and responsibilities of the transportation needs study committee, as set forth in Section 247.659a of the Michigan Compiled Laws, are hereby transferred to the state transportation commission, by a Type III transfer, as defined by Section 3 of Act No. 380 of the Public Acts of 1965, as amended, being Section 16.103 of the Michigan Compiled Laws.
2. The Director of the Department of Transportation shall provide executive direction and supervision for the implementation of the transfer. The assigned functions shall be administered by the state transportation commission.
3. All records, personnel, property and unexpended balances of appropriations, allocations and other funds used, held, employed, available or to be made available to the transportation needs study committee are hereby transferred to the state transportation commission.
4. All the statutory authority, powers, duties, functions and responsibilities of the citizens advisory committee, as set forth in Section 247.659a of the Michigan Compiled Laws, are hereby transferred to the Director to the Department of Transportation, by a Type III transfer, as defined by Section 3 of Act No. 380 of the Public Acts of 1965, as amended, being Section 16.103 of the Michigan Compiled Laws.
5. The Director of the Department of Transportation shall provide executive direction and supervision for the implementation of the transfer. The assigned functions shall be administered by the Director of the Department of Transportation.
6. All records, personnel, property and unexpended balances of appropriations, allocations and other funds used, held, employed, available or to be made available to the citizens advisory committee are hereby transferred to the Director of the Department of Transportation.
7. The Director of the Department of Transportation shall make internal organizational changes as may be administratively necessary to complete the realignment of responsibilities prescribed by this Order.
8. The Director of the Department of Transportation shall immediately initiate coordination to facilitate the transfers and develop a memorandum of record identifying any pending business before the transportation needs study committee and the citizens advisory committee.
9. All rules, orders, contracts and agreements relating to the assigned functions lawfully adopted prior to the effective date of this Order shall continue to be effective until revised, amended or repealed.
10. Any suit, action or other proceeding lawfully commenced by, against or before any entity affected by this Order shall not abate by reason of the taking effect of this Order. Any suit, action or other proceeding may be maintained by, against or before the appropriate successor of any entity affected by this Order.
11. The transportation needs study committee and the citizens advisory committee are hereby abolished.
In fulfillment of the requirement of Article V, Section 2, of the Constitution of the State of Michigan of 1963, the provisions of this Executive Order shall become effective 60 days after filing.

April 1, 1997
Today I have vetoed and am returning to you herewith, Enrolled Senate Bill 93.
Enrolled Senate Bill 93 attempted to correct the failure of the legislature to give Enrolled Senate Bill 112 immediate effect, leaving the act with an effective date of March 31, 1997. Enrolled Senate Bill 112 was filed on January 22, 1997, and is now Public Act 591 of 1996. In the accompanying signing letter, I called for the legislature to act quickly to address this glaring omission. Senate Bill 93 was introduced on January 28, 1997, and passed the Senate on February 5, 1997. Unfortunately, the House of Representatives did not pass the bill until March 19, 1997, and it wasn't presented to me until March 26, 1997.
The failure of the House to act promptly on this legislation means that signing this bill would no longer address the problem it was designed to fix. Instead, it would create confusion and likely spawn protracted litigation.
There are technical issues in this bill which I believe are confusing. For example, Public Act 591 of 1996 created a new definition of the term "subdivide" or "subdivision." Enrolled Senate Bill 93 would reinstate the old definition as it was prior to the enactment of Public Act 591 of 1996. Then after re-enacting the old language, it proposes that it sunset on March 30, 1997. It would be confusing to have two definitions of the same term follow one another in the statute, one of them already outdated.
For these reasons, and with the support of the sponsor, I am returning Enrolled Senate Bill 93 without signature.
