A SUMMARY OF HOUSE BILL 5858 AS INTRODUCED 5-13-98


House Bill 5858 would amend the architects, professional engineers, and land surveyors article of the Occupational Code. The bill would exempt a person licensed when the person is planning, designing, or directing the construction of a single-family detached residential building, regardless of the building's size, if a permit is issued in the person's name to perform the activity.

Under current law, a person is subject to penalties if he or she submits to a public official or a political subdivision for approval, a permit or plan for filing as a public record (including a land survey) that does not bear appropriate seals of a licensee. House Bill 5858 would specify that this requirement would not apply to a single-family detached residential building, regardless of the building's's size, for which a permit is issued to a person licensed under Article 24 as a residential builder.
