CONTENT


The bill would amend the Mobile Home Commission Act to increase from 11 to 13 the number of members appointed to the Mobile Home Commission, and to specify who would serve as the additional members. The bill also would add that a local government zoning ordinance would not be out of compliance with a provision of the Act unless the noncompliance had been determined by a court order.


Currently, two operators of a licensed mobile home park with at least 100 sites and one operator of a licensed mobile home park with fewer than 100 sites must be appointed to the Commission. The bill would require, instead, that one operator of a licensed mobile home park be appointed. In addition, the bill would require a representative from each of the following to be appointed: an environmental advocacy organization, an organization whose membership consisted of township officials, an organization whose membership consisted of municipal officials, and a housing advocacy organization. The remaining members would still include a representative of an organization of mobile home residents, a representative of financial institutions, a representative of organized labor, an elected official of a local government, a licensed mobile home dealer, a mobile home manufacturer, one resident of a mobile home park having at least 100 sites, and one resident of a park with fewer than 100 sites. The bill also would increase from six to seven the number of Commission members who constitute a quorum.


The Act provides that a local government ordinance may not be designed as exclusionary to mobile homes, whether the homes are located inside or outside of mobile home parks or seasonal mobile home parks. Under the bill, a local zoning ordinance would not be out of compliance with this provision unless the noncompliance had been determined by a court order.
