CASINO LICENSE: EXPUNGED CONVICTION - S.B. 576: FLOOR ANALYSIS
Senate Bill 576 (as reported without amendment)
Sponsor: Senator Bill Schuette
Committee: Gaming and Casino Oversight
CONTENT
The bill would amend Public Act 213 of 1965 (which provides for setting aside (expunging) certain criminal convictions) to require a nonpublic record of an expunged conviction to be provided to the Michigan Gaming Control Board for its consideration if a person whose conviction had been set aside applied for a license under the Michigan Gaming Control and Revenue Act.
(Public Act 213 requires the Department of State Police to retain a nonpublic record of an order setting aside a conviction. This nonpublic record may be made available only to a court, a judicial branch agency, a law enforcement agency, a prosecuting attorney, the Attorney General, or the Governor, and only for certain purposes. A copy of the record also may be provided to the person whose conviction is set aside.)
