DRIVING DRUNK OR W/OUT A LICENSE - S.B. 626 (S-1): FLOOR ANALYSIS

CONTENT


The bill would amend the Michigan Vehicle Code to do the following:


-- Require a police officer to confiscate a vehicle's registration plate and issue a temporary plate when the officer stopped a person for a moving violation and determined that he or she was driving without a license; and require the court to order that a restricted plate be issued, that the vehicle be immobilized, that the operation of the vehicle be restricted; or that the vehicle be forfeited (depending upon the number of prior offenses).

-- Provide for the issuance of a restricted registration plate, upon court order, if an applicant paid a $125 service fee and the vehicle owner or lessor signed an acknowledgement that the vehicle would be subject to immobilization or forfeiture if the violator committed a drunk driving offense of drove without a license.

-- Require a court to order a vehicle immobilized for a drunk driving offense or driving without a license, by the installation of a device that locked the ignition, wheels, or steering in a manner that prohibited any person from operating the vehicle.

-- Allow the Secretary of State to deny or refuse to conduct any transaction under the Code or the Natural Resources and Environmental Protection Act that required a monetary payment, if a person operated a vehicle without a license three or more times within the past seven years.

-- Require the State Police annual report to include the number of arrests for drunk driving with a child under 16 in the vehicle, the number of immobilized vehicles or forfeited, and the number of restricted plates issued.

-- Delete license sanction provisions for driving with liquor in an open container, or for a minor's transporting or possessing liquor in a vehicle.


The bill would take effect May 1, 1998, and is tie-barred to Senate Bills 268, 269, 271, 625, 627, 870, 953, 989, 990, and 991.
