CONTENT


The bill would amend Chapter 47 of the Revised Judicature Act to allow the seizure and forfeiture of property involved in a violation of Part 111 (Hazardous Waste Management) or Part 121 (Liquid Industrial Waste) of the Natural Resources and Environmental Protection Act (NREPA).


Chapter 47 provides for the seizure and forfeiture of property that is the proceeds or instrumentality of a crime. The bill would amend the definition of "crime" to include a violation of Part 111 or 121.


The bill would take effect on July 1, 1998. The bill is tie-barred to Senate Bill 554, which would create the "Hazardous Materials Transportation Act", and to Senate Bills 729 and 730, which would amend Parts 111 and 121 of the NREPA.
