CONTENT
The bill would amend the Mental Health Code to repeal the March 29, 1999, statutory sunset on a provision that permits Community Mental Health Services Programs (CMHSPs) to carry forward up to 5% of their State funding from one fiscal year to the next fiscal year.

FISCAL IMPACT
The bill would have no fiscal impact on State government. The 5% carry-forward is currently permitted under State law; thus, passage of the bill would not change current policy. If this bill is not enacted, then as of March 29, 1999, Community Mental Health Services Programs will no longer be able to carry forward up to 5% of their State funding. This would likely lead to some Community Mental Health Services Programs' lapsing an indeterminate amount of money to the State General Fund. Past experience indicates that, given the alternate possibilities of allowing money to lapse to the State General Fund and spending the money on equipment and other expenses at the end of the fiscal year, the Community Mental Health Services Programs tend to choose the latter; thus, the amount lapsing to the State will likely be minimal.
