H.B. 5613 (H-1): COMMITTEE SUMMARY - MARRIAGES BY COUNTY CLERKS

House Bill 5613 (Substitute H-1 as passed by the House)

Sponsor: Representative Liz Brater

House Committee: Local Government

Senate Committee: Local, Urban and State Affairs

Date Completed: 5-20-98

CONTENT

The bill would amend an Act entitled "Of marriage and the solemnization thereof" to permit a county clerk to solemnize a marriage if the marriage were solemnized in the county in which the clerk served.

Currently, a clerk of a county having more than 2 million inhabitants or an employee of the clerk's office designated by the county clerk in the county in which the clerk serves may solemnize a marriage. Under the bill, a county clerk in a county other than a county organized under Public Act 293 of 1966, which provides for the establishment of charter counties, could solemnize a marriage if it were solemnized in the county in which the clerk served. The bill also would permit a county clerk or a designated employee of the county clerk in a county organized under Public Act 293 to solemnize a marriage in the county in which the clerk served.
