A bill to provide for adoption of an official song and des- ignation of other melodies that represent the musical heritage of this state; to create a commission and prescribe the powers and duties of the commission; and to prescribe the powers and duties of certain state officials. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Commission" means the Michigan state song commission 3 created in section 3. 4 (b) "Immediate family member" means an individual related to 5 a person within the third degree of consanguinity or related to 6 that person's spouse within the third degree of consanguinity. 7 (b) "Person" means an individual, partnership, corporation, 8 association, limited liability company, governmental entity, or 9 other legal entity. 00820'97 JLB 2 1 Sec. 3. (1) The Michigan state song commission is created 2 within the department of state. 3 (2) The commission shall consist of 1 member appointed by 4 each of the following: 5 (a) The governor. 6 (b) The senate majority leader. 7 (c) The senate minority leader. 8 (d) The speaker of the house of representatives. 9 (e) The minority leader of the house of representatives. 10 (f) The attorney general. 11 (g) The secretary of state. 12 (3) The following persons are not eligible to serve as a 13 member of the commission: 14 (a) A member of the legislature. 15 (b) A person who submits a song or melody to the commission 16 for consideration. 17 (c) A person whose immediate family member submits a song or 18 melody to the commission for consideration. 19 (d) A person who is a member of an organization that submits 20 a song or melody to the commission for consideration. 21 (4) Members of the commission shall serve for terms of 2 22 years, or until a successor is appointed, whichever is later. 23 (5) If a vacancy occurs on the commission, the appointment 24 for the unexpired term shall be filled in the same manner as the 25 original appointment. 26 (6) The first meeting of the commission shall be held not 27 later than February 1, 1998. 00820'97 3 1 (7) A majority of the members of the commission constitutes 2 a quorum for the transaction of business at a meeting of the 3 commission. Action by the commission shall be by a majority of 4 the votes cast. 5 (8) Members of the commission shall serve without 6 compensation. However, members of the commission may be reim- 7 bursed for their actual and necessary expenses incurred in the 8 performance of their official duties as members of the 9 commission. 10 Sec. 5. (1) The commission shall meet and evaluate songs 11 and melodies submitted to the commission by residents of this 12 state. 13 (2) The commission shall designate and adopt 1 or more songs 14 as the state song or state songs. 15 (3) The commission may also designate and adopt other melo- 16 dies that represent the musical heritage of this state. 17 Sec. 7. (1) Once a song or melody is designated and adopted 18 by the commission under section 5, the commission shall not 19 divulge or release the name of the song or melody to any person 20 who is not a member of the commission until the first Monday of 21 Michigan week in 1998. 22 (2) On the first Monday of Michigan week in 1998, the com- 23 mission shall issue a joint press release, in conjunction with 24 the governor and the legislative sponsors of this act, describing 25 the songs and melodies designated and adopted under section 5. 00820'97 Final page.
