A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1267 (MCL 380.1267), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1267. (1) Before EXCEPT AS OTHERWISE PROVIDED IN 2 THIS SECTION, BEFORE commencing construction of a new school 3 building, or addition to or repair or renovation of an existing 4 school building, except repair in emergency situations, the board 5 of a school district or board of directors of a public school 6 academy , shall obtain competitive bids on all the material and 7 labor required for the complete construction of a proposed new 8 building or addition to or repair or renovation of an existing 9 school building. 01805'97 TAV 2 1 (2) The board or board of directors shall advertise for the 2 bids required under subsection (1) once each week for 2 3 successive weeks in a newspaper of general circulation in the 4 area where the building or addition is to be constructed or where 5 the repair or renovation of an existing building is to take 6 place. The advertisement for bids shall do all of the 7 following: 8 (a) Specify the date and time by which all bids must be 9 received by the board or board of directors. 10 (b) State that the board or board of directors will not con- 11 sider or accept a bid received by the board or board of directors 12 after the date and time specified for bid submission. 13 (c) Identify the time, date, and place of a public meeting 14 at which the board or board of directors or its designee will 15 open and read aloud each bid received by the board or board of 16 directors by the date and time specified in subdivision (a). 17 (3) The board or board of directors shall require each 18 bidder for a contract under this section to file with the board 19 or board of directors security in an amount not less than 1/20 of 20 the amount of the bid conditioned to secure the school district 21 from loss or damage by reason of the withdrawal of the bid or by 22 the failure of the bidder to enter a contract for performance, if 23 the bid is accepted by the board or board of directors. 24 (4) The board or board of directors shall not open, consid- 25 er, or accept a bid that the board or board of directors receives 26 after the date and time specified for bid submission in the 27 advertisement for bids described in subsection (2). 01805'97 3 1 (5) At a public meeting identified in the advertisement for 2 bids described in subsection (2), the board or board of directors 3 or its designee shall open and read aloud each bid that the board 4 or board of directors received at or before the time and date for 5 bid submission specified in the advertisement for bids. The 6 board or board of directors may reject any or all bids, and if 7 all bids are rejected, shall readvertise in the manner required 8 by this section. 9 (6) This section does not apply to buildings, renovations, 10 or repairs costing less than $12,500.00 or to repair work nor- 11 mally performed by school district OR PUBLIC SCHOOL ACADEMY 12 employees. The maximum amount specified in this subsection shall 13 be adjusted each year by multiplying the amount for the immedi- 14 ately preceding year by the percentage by which the average con- 15 sumer price index for all items for the 12 months ending 16 August 31 of the year in which the adjustment is made differs 17 from that index's average for the 12 months ending on August 31 18 of the immediately preceding year and adding that product to the 19 maximum amount that applied in the immediately preceding year, 20 rounding to the nearest whole dollar. 21 (7) THIS SECTION DOES NOT APPLY TO LABOR FOR CONSTRUCTION, 22 ADDITION, REPAIR, OR RENOVATION OF A BUILDING USED BY A SCHOOL 23 DISTRICT OR PUBLIC SCHOOL ACADEMY FOR NONINSTRUCTIONAL PURPOSES 24 IF THE LABOR IS PERFORMED BY PUPILS OF THE SCHOOL DISTRICT OR 25 PUBLIC SCHOOL ACADEMY WHO ARE ENROLLED IN A VOCATIONAL EDUCATION 26 COURSE. 01805'97 Final page.
