A bill to require automatic lighting in parking lots of cer- tain retail businesses; and to provide penalties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "retail parking lot lighting act". 3 Sec. 2. As used in this act: 4 (a) "Automatic lighting system" means a lighting system that 5 activates automatically at dusk or in other low natural light 6 conditions. 7 (b) "Person" means an individual, partnership, corporation, 8 association, or other legal entity. 9 (c) "Retail business" means a person who engages in the 10 retail sale of goods or services to customers in the ordinary 11 course of business. 00778'97 FDD 2 1 (d) "Retail parking lot" means a parking lot of 20 or more 2 spaces available to customers of a retail business. 3 Sec. 3. (1) A person who operates a retail business that 4 offers a retail parking lot to its customers shall install an 5 automatic lighting system in that retail parking lot. An auto- 6 matic lighting system installed pursuant to this subsection shall 7 include a sufficient number of lights to adequately illuminate 8 the retail parking lot in which the automatic lighting system is 9 installed. 10 (2) An automatic lighting system installed pursuant to sub- 11 section (1) shall be maintained so that the retail parking lot in 12 which the automatic lighting system is installed is adequately 13 illuminated. 14 Sec. 4. (1) A person who fails to install an automatic 15 lighting system as required under section 3(1) within 30 days 16 after the effective date of this act is liable for a civil fine 17 of $500.00 per day until the automatic lighting system is 18 installed. 19 (2) A person who fails to maintain an automatic lighting 20 system as required under section 3(2) is liable for a civil fine 21 of $500.00 per day until the automatic lighting system is main- 22 tained so that the automatic lighting system provides adequate 23 illumination. 00778'97 Final page.
