        A bill to amend 1974 PA 258, entitled

   "Mental health code,"

   by amending section 142 (MCL 330.1142), as amended by 1995 PA

   290.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 142.  The governing body of a facility licensed under

 2    sections 134 through 150 shall certify to the department of

 3    mental health that its policies, procedures, and practices are

 4    consistent with the Americans with disabilities act of 1990,

 5    Public Law 101-336, 104 Stat. 327, the rehabilitation act of

 6    1973, Public Law 93-112, 87 Stat. 355, the Elliott-Larsen civil

 7    rights act,  Act No. 453 of the Public Acts of 1976, being

 8     sections 37.2101 to 37.2804 of the Michigan Compiled Laws  1976

 9    PA 453, MCL 37.2101 TO 37.2804, and the  Michigan handicappers' 

10    PERSONS WITH DISABILITIES civil rights act,  Act No. 220 of the

 1    Public Acts of 1976, being sections 37.1101 to 37.1607 of the

 2     Michigan Compiled Laws  1976 PA 220, MCL 37.1101 TO 37.1607.  The

 3    governing body shall direct the administrator of the facility to

 4    take such action as is necessary to assure that the facility

 5    adheres to all of the nondiscriminatory laws described in this

 6    section.

 7         Enacting section 1.  This amendatory act does not take

 8    effect unless Senate Bill No. 352 of the 89th Legislature is

 9    enacted into law.
