A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 74113 and 74117 (MCL 324.74113 and 324.74117), as added by 1995 PA 58. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 74113. All EXCEPT AS PROVIDED IN SECTION 74117(3), 2 ALL state park revenues shall be deposited with the state trea- 3 surer who shall act as the fiscal agent for the department. The 4 state treasurer shall establish a special depositary account to 5 be designated "state park revenue bond receiving fund". The nec- 6 essary expenses of the fiscal agent incurred by reason of his or 7 her duties under this part shall be paid from the state park rev- 8 enue bond receiving fund. The commission DEPARTMENT may 9 designate banks or trust companies to act as paying agents for 03530'97 JCB 2 1 bonds issued pursuant to this part. The paying agent shall be 2 paid from the state park debt service fund. 3 Sec. 74117. (1) The department may require park permits and 4 collect park permit fees for entry into a state park or portion 5 of a state park posted in the manner prescribed by this part. 6 The department shall prepare and distribute park permits to 7 implement this part. 8 (2) Except as otherwise provided in this section, an annual 9 park permit shall be issued and shall authorize the entry of the 10 motor vehicle to which it is originally attached within the con- 11 fines of any state park or recreation area during the calendar 12 year in which issued. The fee for the annual park permit is 13 $18.00 in 1994, and $20.00, in 1995 and thereafter, except 14 that an owner of a resident motor vehicle who is 65 years of age 15 or older shall be issued a special annual park permit for 1/4 the 16 amount of the annual park permit. 17 (3) A daily park permit, valid for 1 day only, shall be 18 issued for a fee to be fixed by the department, but in an amount 19 not to exceed $4.00 for resident motor vehicles and $6.00 20 $10.00 for nonresident motor vehicles. The fee for nonresident 21 motor vehicles may be $4.00 in all parks except where nonresident 22 day use is extremely high. The department shall identify parks 23 where nonresident day use is extremely high and set the nonresi- 24 dent fee at $6.00 $10.00. The daily permit shall authorize the 25 entry of the motor vehicle to which it is originally attached 26 within the confines of a state park during the day in which 27 issued. AT STATE PARKS IN WHICH THE NONRESIDENT DAILY PARK 03530'97 3 1 PERMIT FEE IS SET AT $10.00, $4.00 OF THE AMOUNT COLLECTED FOR 2 EACH NONRESIDENT DAILY PARK PERMIT SHALL BE FORWARDED TO THE 3 STATE TREASURER FOR DEPOSIT INTO THE MICHIGAN TRANSPORTATION FUND 4 CREATED IN SECTION 10 OF 1951 PA 51, MCL 247.660. 5 (4) A resident motor vehicle is a vehicle that is registered 6 as a motor vehicle in this state. 7 (5) This part applies only to the entry of motor vehicles 8 into the state parks and to the park permits authorized in this 9 part and does not obviate the necessity of obtaining additional 10 permits for special services or park privileges as previously or 11 subsequently may be required by law or by rules promulgated by 12 the department. The department shall designate each person in 13 the state authorized to sell park permits and shall require as a 14 condition of the designation that a surety bond be furnished in 15 an amount and in a form and with the surety as is acceptable to 16 the department. A person designated by the department after 17 being designated may issue park permits in accordance with this 18 part. 19 (6) Commercial motor coaches or vans are not eligible to 20 enter a state park with an annual park permit. The department 21 may establish a daily fee not to exceed $15.00 to allow commer- 22 cial motor coaches or vans with a capacity of over 12 passengers 23 daily entry into a state park. 24 (7) The department may add to the cost of a reservation or 25 for payment for a motor vehicle entrance or camping fee the 26 charges that the state incurs because of the use of a credit 27 card. 03530'97
