HOUSE BILL No. 5173


     September 30, 1997, Introduced by Reps. Brater, Brackenridge and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1988 PA 57, entitled

   "An act to provide for the incorporation by 2 or more municipali-
   ties of certain authorities for the purpose of providing emer-
   gency services to municipalities; to provide for the powers and
   duties of authorities and of certain state and local agencies and
   officers; to guarantee certain labor contracts and employment
   rights in regard to the formation and reorganization of authori-
   ties; to provide for certain condemnation proceedings; and to
   provide for the levy of property taxes for certain purposes,"

   (MCL 124.601 to 124.614) by amending the title and by adding sec-

   tion 4a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the incorporation by 2 or more munici-

 3    palities of certain authorities for the purpose of providing

 4    emergency services to municipalities; to provide for the powers

 5    and duties of authorities and of certain state and local agencies

 6    and officers; to guarantee certain labor contracts and employment

 1    rights in regard to the formation and reorganization of

 2    authorities; to provide for certain condemnation proceedings;

 3     and  to provide for the levy of property taxes for certain

 4    purposes; AND TO PRESCRIBE PENALTIES AND PROVIDE REMEDIES.

 5         SEC. 4A.  A PETITION UNDER SECTION 4, INCLUDING THE CIRCULA-

 6    TION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

 7    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

 8    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

 9    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

10    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

11    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

12    168.992.

13         Enacting section 1.  This amendatory act does not take

14    effect unless Senate Bill No. _____ or House Bill No. _____

15    (request no. 02378'97) of the 89th Legislature is enacted into

16    law.
