January 14, 1998, Introduced by Rep. Wetters and referred to the Committee on Tax Policy. A bill to amend 1947 PA 359, entitled "The charter township act," by amending section 31 (MCL 42.31). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 31. Each charter township may make local or public 2 improvements by the paving of streets which THAT are not a 3 part of the county highway system, the laying of curbs and 4 gutters, the installing of elevated structures for foot 5 travel over highways within the township with the written 6 approval of the director of the state transportation department 7 if the highways are state highways or with the written approval 8 of the board of county road commissioners if the highways are 9 county roads, the laying of sidewalks, the installation of 10 INSTALLING solid waste disposal systems, steam generation and 11 distribution, the paving of streets which THAT are a part 02197'97 TLG 2 1 of the county highway system with the consent of and according to 2 specifications of the county road commission, the laying of 3 storm and sanitary sewers AND SEPARATING STORM WATER DRAINAGE 4 FROM SANITARY SEWERS ON PRIVATELY OWNED PROPERTY FOR A PUBLIC 5 PURPOSE, the installation of INSTALLING water systems, and the 6 installation of INSTALLING street and highway lighting systems, 7 and further may maintain or operate the same THESE 8 IMPROVEMENTS. The township board of each charter township may 9 determine the necessity of the local or public improvement and 10 may determine that the whole or any part of the expense of the 11 local or public improvement shall be defrayed by special assess- 12 ment upon lands abutting upon and adjacent to or otherwise bene- 13 fited by the improvement. , the A SPECIAL assessment to UNDER 14 THIS SECTION SHALL be made in all respects as provided for the 15 making of special assessments under Act No. 188 of the Public 16 Acts of 1954, as amended, being sections 41.721 to 41.737 of the 17 Michigan Compiled Laws 1954 PA 188, MCL 41.721 TO 41.738. Each 18 charter township may borrow money and issue bonds therefor in 19 anticipation of the payment of special assessments, which may be 20 an obligation of the special assessment district or may be both 21 an obligation of the special assessment district and a general 22 obligation of the township. , which bonds BONDS ISSUED UNDER 23 THIS ACT shall be issued in accordance with Act No. 188 of the 24 Public Acts of 1954, as amended 1954 PA 188, MCL 41.721 TO 25 41.738. 02197'97 Final page.
