HOUSE BILL No. 5479 January 14, 1998, Introduced by Reps. Rhead, McBryde, Birkholz, Voorhees, Hammerstrom, Gilmer, Johnson, Dalman, Oxender, Gernaat, Fitzgerald, Goschka, McNutt and Llewellyn and referred to the Committee on Colleges and Universities. A bill to require institutions of higher education to pre- pare and distribute certain reports to certain persons and state agencies; and to provide certain powers and duties of certain state agencies and officials. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "Michigan campus security awareness act". 3 Sec. 3. As used in this act: 4 (a) "Branch campus" means a unit of an institution of higher 5 education that is distinguished by all of the following 6 characteristics: 7 (i) Offers all or part of an academic degree-granting pro- 8 gram on a continuing basis. 9 (ii) Is located in a location that is separately 10 identifiable from the main campus of the parent institution and 04735'97 JJG 2 1 that provides services normally associated with the parent 2 institution. 3 (iii) Derives legal authority for governance, administra- 4 tion, and general operation from the authority of the parent 5 institution. 6 (b) "Institution of higher education" or "institution" means 7 a public or private degree-granting college, community college, 8 junior college, or university located in this state. 9 (c) "Student housing" means a residence hall or a sorority 10 or fraternity residence owned or under the control of the insti- 11 tution of higher education. 12 Sec. 5. An institution of higher education shall submit to 13 the department of state police and to the department of education 14 a uniform crime report containing the information specified in 15 section 1 of 1968 PA 319, MCL 28.251, covering crimes reported 16 occurring on property owned or under the control of the 17 institution. The report shall be submitted not later than August 18 1 of each year on a form furnished by the director of the depart- 19 ment of state police. 20 Sec. 7. (1) An institution of higher education shall pub- 21 lish a campus crime report and update it annually. The campus 22 crime report shall contain the crime statistics reported in the 23 uniform crime report under section 5 for the immediately preced- 24 ing 3-year period and the crime rates for each of those years in 25 each category of crime reported under section 5, based on the 26 numbers of crimes reported under section 5 and the number of 04735'97 3 1 full-time equivalent undergraduate and graduate students and 2 full-time equivalent employees at the institution. 3 (2) An institution shall provide a copy of the campus crime 4 report at least annually to the department of education and to 5 each employee and enrolled student. Upon request, the institu- 6 tion shall provide a copy of the campus crime report to each new 7 employee at the time of employment and to each applicant for 8 admission. In its acknowledgment of receipt of a formal applica- 9 tion for admission, the institution shall notify the applicant 10 that a campus crime report is available upon request. 11 (3) If an institution of higher education has 1 or more 12 branch campuses, the institution shall publish a separate campus 13 crime report pursuant to subsection (1) for each branch campus 14 and the main campus, and shall distribute the crime report for 15 the appropriate campus to the individuals entitled to a copy of 16 the report under subsection (2). 17 Sec. 9. (1) Subject to subsection (2), an institution of 18 higher education shall provide information regarding the 19 institution's security policies and procedures to each applicant 20 for admission at the time of acknowledgment of receipt of a 21 formal application for admission, to each new employee at the 22 time of employment, and annually to each employee and enrolled 23 student. An institution within 1 or more branch campuses shall 24 provide to each individual the security information about the 25 appropriate campus. The security information shall be accurate 26 and complete for the academic year in which it is distributed and 27 shall include at least all of the following: 04735'97 4 1 (a) The number of undergraduate and graduate students 2 enrolled in the institution. 3 (b) The number of undergraduate and graduate students living 4 in student housing. 5 (c) The number of nonstudent employees working at the 6 campus. 7 (d) The administrative office responsible for campus 8 security. 9 (e) A description of the type and number of security person- 10 nel used by the institution, and a description of their 11 training. 12 (f) The enforcement authority of security personnel, includ- 13 ing, but not limited to, their working relationship with state, 14 local, and campus police agencies. 15 (g) Whether the institution has its own police agency, and, 16 if so, the authority of the officers employed by the agency. 17 (h) Policy on reporting criminal incidents to state and 18 local police. 19 (i) Policy regarding access to the institution's facilities 20 and programs by students, employees, guests, and other 21 individuals. 22 (j) Procedures and facilities for students and other indi- 23 viduals to report criminal incidents or other emergencies on 24 campus and policies concerning the institution's response to 25 those reports. 26 (k) Policy regarding the possession, use, and sale of 27 alcoholic beverages. 04735'97 5 1 (l) Policy regarding the possession, use, and sale of 2 illegal drugs. 3 (m) Policy regarding possession and use of weapons by secur- 4 ity personnel and other individuals. 5 (n) Policy, if any, regarding students or employees with 6 criminal records. 7 (o) Security considerations used in the maintenance of 8 campus facilities, including, but not limited to, landscaping, 9 grounds keeping, and outdoor lighting. 10 (p) A description of the communication media used to inform 11 the campus community about security matters and of the frequency 12 with which that information is usually provided. 13 (2) If an institution maintains student housing, the infor- 14 mation required under this section shall also include at least 15 all of the following: 16 (a) Description of each of the types of student housing 17 available, such as on-campus, off-campus; single room, double, 18 group; single sex, coed; undergraduate, graduate, or married. 19 (b) Policies on housing assignments and on requests by stu- 20 dents for assignment changes. 21 (c) Policies concerning the identification and admission of 22 visitors in student housing facilities. 23 (d) Measures used to secure entrances to student housing 24 facilities. 25 (e) Standard security features used to secure doors and win- 26 dows in students' rooms. 04735'97 6 1 (f) A description of the type, number, and security training 2 of security personnel and other employees assigned to student 3 housing facilities. 4 (g) The type and frequency of programs designed to inform 5 student housing residents about housing security and enforcement 6 procedures. 7 (h) Policy and any special security procedures for housing 8 students during holiday, vacation, and other low-occupancy 9 periods. 10 (i) Policy on housing of guests and other individuals who 11 are not assigned student housing or not regularly associated with 12 the institution. 13 Sec. 11. If the attorney general has cause to believe that 14 an institution of higher education is violating this act, the 15 department of attorney general may bring an action on behalf of 16 the state against the institution to compel compliance. 04735'97 Final page.
