A bill to amend 1990 PA 325, entitled "Michigan museum act," by amending sections 110 and 210 (MCL 399.410 and 399.510). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 110. (1) The department shall encourage the creation 2 of an officially recognized friends of the maritime museum organ- 3 ization designed to provide funding, promotional support, volun- 4 teer labor, and other forms of assistance to the maritime 5 museum. 6 (2) If established, the officially recognized friends of the 7 maritime museum organization may do all of the following: 8 (a) Make expenditures on behalf of the programs of the mari- 9 time museum, if such expenditures are requested by the 10 department. 01878'97 DMS 2 1 (b) Use the facilities of the maritime museum without charge 2 upon receipt of written permission from the department to do so. 3 Use of the maritime museum facilities shall be in keeping with 4 the authorized purposes of the friends of the maritime museum 5 organization, shall not be made at times and places that would 6 unreasonably interfere with opportunities of the general public 7 to use the facilities for established purposes, and shall be 8 subject to the other provisions of this section. 9 (c) Engage in fund-raising activities at the maritime 10 museum. 11 (d) Operate a maritime museum store or other sales facili- 12 ties, or both, if the department enters into a concession agree- 13 ment with the friends of the maritime museum organization. 14 (3) To qualify as the officially recognized friends of the 15 maritime museum organization, an organization shall do all of the 16 following: 17 (a) Incorporate under the laws of the state of Michigan. 18 (b) Operate on a nonprofit basis. 19 (c) Request written approval from the department, using pro- 20 cedures and forms prescribed by the department, to function as an 21 officially recognized friends of the maritime museum 22 organization. 23 (4) Except as provided in subsection (5), if an entity qual- 24 ifies as the officially recognized friends of the maritime museum 25 organization, the department shall issue a letter of certifica- 26 tion recognizing the friends of the maritime museum 27 organization's qualifications. The letter shall specify the 01878'97 3 1 conditions under which the friends of the maritime museum 2 organization may make expenditures on behalf of the maritime 3 museum and may include other appropriate provisions. 4 (5) Nothing in this section requires the department to cer- 5 tify a friends of the maritime museum organization that meets the 6 qualifications prescribed in this section. 7 (6) The department may promulgate rules pursuant to the 8 administrative procedures act of 1969, Act No. 306 of the Public 9 Acts of 1969, being sections 24.201 to 24.328 of the Michigan 10 Compiled Laws 1969 PA 306, MCL 24.201 TO 24.328, to establish 11 special conditions with which the friends of the maritime museum 12 organization shall comply in order to use maritime museum 13 facilities. 14 (7) The department shall not permit the use of museum facil- 15 ities if the friends of the maritime museum organization fails to 16 provide membership and employment opportunities to all persons 17 regardless of race, color, religion, sex, age, national origin, 18 or physical handicap DISABILITY. 19 Sec. 210. (1) The department shall encourage the creation 20 of an officially recognized friends of the depot organization 21 designed to provide funding, promotional support, volunteer 22 labor, and other forms of assistance to the railroad history 23 museum. 24 (2) If established, the officially recognized friends of the 25 depot organization may do all of the following: 01878'97 4 1 (a) Make expenditures on behalf of the programs of the 2 railroad history museum, if such expenditures are requested by 3 the department. 4 (b) Use the facilities of the railroad history museum with- 5 out charge upon receipt of written permission from the department 6 to do so. Use of the railroad history museum facilities shall be 7 in keeping with the authorized purposes of the friends of the 8 depot organization, shall not be made at times and places that 9 would unreasonably interfere with opportunities of the general 10 public to use the facilities for established purposes, and shall 11 be subject to the other provisions of this section. 12 (c) Engage in fund-raising activities at the railroad his- 13 tory museum. 14 (d) Furnish volunteer labor to perform services in the rail- 15 road history museum store and in connection with other programs 16 at the railroad history museum. 17 (3) To qualify as the officially recognized friends of the 18 depot organization, an organization shall do all of the 19 following: 20 (a) Incorporate under the laws of the state of Michigan. 21 (b) Operate on a nonprofit basis. 22 (c) Request written approval from the department, using pro- 23 cedures and forms prescribed by the department, to function as an 24 officially recognized friends of the depot organization. 25 (4) Except as provided in subsection (5), if an entity qual- 26 ifies as the officially recognized friends of the depot 27 organization, the department shall issue a letter of 01878'97 5 1 certification recognizing the organization's qualifications. The 2 letter shall specify the conditions under which the friends of 3 the depot organization may make expenditures on behalf of the 4 railroad history museum and may include other appropriate 5 provisions. 6 (5) Nothing in this section requires the department to cer- 7 tify a friends of the depot organization that meets the qualifi- 8 cations prescribed in this section. 9 (6) The department may promulgate rules pursuant to the 10 administrative procedures act of 1969, Act No. 306 of the Public 11 Acts of 1969, being sections 24.201 to 24.328 of the Michigan 12 Compiled Laws 1969 PA 306, MCL 24.201 TO 24.328, to establish 13 special conditions with which the friends of the depot organiza- 14 tion shall comply in order to use railroad history museum 15 facilities. 16 (7) The department shall not permit the use of railroad his- 17 tory museum facilities if the friends of the depot organization 18 fails to provide membership and employment opportunities to all 19 persons regardless of race, color, religion, sex, age, national 20 origin, or physical handicap DISABILITY. 01878'97 Final page.
