     February 19, 1997, Introduced by Reps. Owen, Galloway, Green, Walberg, Nye, Alley, Mans, McBryde, Jaye, Rhead, Goschka, Raczkowski, Dobronski, Mathieu and Bodem and referred to the Committee on House Oversight and Ethics.


        A joint resolution proposing an amendment to the state con-

   stitution of 1963, by amending section 46 of article IV, to pro-

   vide for the death penalty in certain circumstances.

        Resolved by the Senate and House of Representatives of the

   state of Michigan, That the following amendment to the state con-

   stitution of 1963, to provide for the death penalty in certain

   circumstances, is proposed, agreed to, and submitted to the

   people of the state:

 1                                ARTICLE IV

 2         Sec. 46.  No law shall be enacted providing for the penalty

 3    of death EXCEPT FOR FIRST DEGREE MURDER OF A CORRECTIONS OFFICER

 4    PERFORMING HIS OR HER DUTIES AS A CORRECTIONS OFFICER OR BECAUSE

 5    OF HIS OR HER EMPLOYMENT AS A CORRECTIONS OFFICER.  THE

 6    LEGISLATURE SHALL PROVIDE BY LAW FOR THE IMPLEMENTATION OF THIS

 7    SECTION.

 2    submitted to the people of the state at the next general election
