(2) The department of Michigan jobs commission shall submit an annual report to the department of management and budget and the fiscal agencies of the house and senate concerning the following:
(a) Expenditures.
(b) Funds received but not appropriated by the state.".

1. Amend page 17, line 18, after "ombudsman--" by striking out "14.0" and inserting "15.0" and adjusting all subtotals, totals and section 201 accordingly.
2. Amend page 42, following line 24, by inserting:
"Sec. 308. The attorney general shall initiate and litigate a civil action to challenge any federal mandate for the state to obtain or disclose an individual's social security number for a purpose unrelated to social security or federal taxation. As used in this section, "federal mandate" includes both of the following:
(a) A requirement of federal law.
(b) A condition imposed by federal law that affects the state's qualification to receive federal funds.".
3. Amend page 57, following line 27, by inserting:
"Sec. 714. The department of management and budget shall notify the chairpersons of the senate and house standing committees on appropriations and the chairpersons of the senate and house appropriations subcommittees on general government on any revisions exceeding $500,000.00 to current contracts for computer software development, hardware acquisition, or quality assurance at least 14 days before the department of management and budget finalizes the revisions.".

2. Amend page 43, following line 26, by inserting:
"Sec. 654. (1) The family independence agency may require substance abuse testing as a condition for family independence assistance. If the family independence agency implements substance abuse testing as provided for by this section as a condition of receiving family independence assistance, an individual who tests positive for substance abuse shall enroll in substance abuse treatment, which treatment shall become a part of the recipient's social contract under section 57e of the social welfare act, 1939 PA 280, MCL 400.57e. Before implementing substance abuse testing as provided for by this section, the family independence agency shall notify the senate and house standing committees having jurisdiction over the social welfare act, 1939 PA 280, MCL 400.1 to 400.119b, and the senate and house appropriations subcommittees having jurisdiction over the family independence agency budget of the planned implementation.
(2) If the family independence agency implements substance abuse testing under subsection (3), the family independence agency shall submit a report on the testing program no later than September 30, 1999 to the senate and house standing committees having jurisdiction over the social welfare act, 1939 PA 280, MCL 400.1 to 400.119b, and the senate and house appropriations subcommittees having jurisdiction over the family independence agency budget. The report shall include at least all of the following information:
(a) The number of individuals tested, the substances tested for, the results of the testing, and the number of referrals for treatment.
(b) The costs of the testing and the resulting treatment.
(c) Sanctions, if any, that have been imposed on recipients as a result of the testing program.
(d) The percentage and number of households receiving family independence assistance that include an individual who has tested positive for substance abuse under the program and that also include an individual who has been substantiated for child abuse or neglect under the child protection law, 1975 PA 238, MCL 722.621 to 722.638.".

"Sec. 608. The department shall not impede the certification process for water control structures on Michigan waterways. All certification conditions necessary for compliance with section 401 of title IV of the federal water pollution control act, chapter 758, 86 Stat. 877, 33 U.S.C. 1341, that are required or requested by the department shall be paid for, by the department, from funds appropriated in section 106.".
4. Amend page 28, line 22, after "section 109," by striking out "$1,000,000.00" and inserting "$1.00".
5. Amend page 31, following line 16, by inserting:
"Sec. 1404. As a condition of expenditure of appropriations under section 105, the department shall issue a combined hunting license for the harvest of deer during firearm, bow and arrow, and any other deer hunting season. The department shall allow the license applicant to determine the number of kill tags to be included in the license. However, the number of kill tags shall not be less than 2 or greater than a maximum number to be set by the department. The license fee shall reflect the number of kill tags included in the license. This section does not prohibit the issuance of any other deer hunting license otherwise provided for by law.".

Senator V. Smith's first statement, in which Senator Young concurred, is as follows:
I rise to oppose passage of Senate Joint Resolution R.
Many view, and I hope the view of at least a solid majority in this chamber is opposed to amending the Michigan Constitution. This Senate Joint Resolution R will amend the Michigan Constitution by eliminating the probate court within the state of Michigan. I believe it's not the right way to go.
One, we can continue with the creation of the family court through a statutory means and not through constitutional amendment. We can, in effect, when we created the family court, we moved juvenile delinquency and its functions from the probate court to the circuit court. We can complete that process by statutorily making those judges circuit court judges and removing them from the probate court bench. We made judges circuit court judges when we eliminated recorder's court judges. I believe we can do this again and not have to amend the Michigan Constitution and destroy the probate court in order to finalize the completion of family court.
I'm also disturbed, Mr.President, by the fact that we want to kill a speciality court, the probate court, in order to create another speciality court, the family division. The family division of circuit court is a specialized court, but it does not have to have the complete elimination of the probate court in order to finish that job off. We, in transferring the functions of the juvenile delinquents to the circuit court, in effect, created the family court and placed within the family court the jurisdiction of all issues related to children and families. What's left in probate court deals with guardianship, deals with wills, deals with estates, and deals with trusts; there is not need to eliminate the probate court, a constitutional court in order to create the family court division.
When we do that, we, in effect, walk away from the specialization that that has had since the inception of this state's history. The probate court is a specialized court--it deals with those in this society who need protecting--children; it deals with aging seniors who need protection, and those protections are given through guardianships. That court and the judges who serve on that court want to handle that type of business. It's a specialized court, and they run for that specialized position. When they are elected, they know that's what they're charged to do; that is to handle the functions and the traditional rolls that the probate court has always handled. Many who practice in probate court realize that it is a specialized practice. Most attorneys who do not practice in the probate court are not quick to want to go and work in the probate court because of the specialized functions and filings that have to go on when you practice in the probate court.
I have passed out a handout, and it includes a number of individuals and associations who are opposed to Senate Joint Resolution R. The first letter that I'll point your attention to is by the president of Wayne County Probate Bar Association. She is absolutely opposed to the abolition of the probate courts in this state. Just to cite some of her words, "To merge these courts within an existing bench of 73 would be a disgrace and a grave loss to the people of the state of Michigan. And Wayne County, with the magnitude of cases our judges here, we have no perimeters to allow circuit court judges without the expertise, skill, and probate background to hear such cases. Probate law is complicated, complex, and highly sensitive." That was from the head of the Probate Bar Association in Wayne County.
There is a letter that was sent to the Honorable Senator Jon Cisky from all of the circuit judges and the probate judges in Saginaw County laying out, in specific language, their opposition to Senate Joint Resolution R. There is a letter that is from the Saginaw Bar Association, and they also have laid out in specifics, and signed by all of their leadership, their opposition to the abolition of the probate courts in this state. Another letter that I included in this package was from the chief judge, the Honorable Joseph Swallow, and Joseph Swallow states unequivocally that he feels that the abolition of probate court is unnecessary. He talks about how this change will affect multi-county circuit courts. Just to state a few of his words, "I have just received The Supreme Court's report, Volume 1, No.7, wherein under the title One Judge per County, the Chief Justice Mallett and the Court, as a key tool to modernization of trial courts: 'As a Chief Judge of 25 plus years of service in a multi-county circuit, I would anticipate the exact opposite results. For decades in Michigan the regional approach for delivering court services has evolved in the less populous areas of this state. I have personally been witness to significant improvement over the prior individual county concept, particularly in the areas of family and children. To now focus on the county rather than on the region would be a big step backwards." What Judge Swallow is making reference to is the first page of the constitutional amendment whereby we mandate that there must be one judge per county, and we also mandate that half the family court has to be part of the practice of that one judge per county. Judge Swallow is giving the same testimony that I also heard from Judge Root in the Senate Judiciary Committee. Both of these judges, longstanding judges in the northern part of our state, raise specific questions with the constitutional mandate of one judge per county and the fact that in the north, they have worked our cooperative arrangements, and those cooperative arrangements between the probate court judge and the circuit court judge have worked. In effect, in the north, they created the family court division, but they created it under the probate court. They brought over the domestic relations part of the circuit court docket into the probate court docket--they created a family court; they created one that works. Now, this Legislature wants to come along behind them and change the way those judges operate. Judge Swallow didn't think it was a good idea; neither did Judge Davis, who wrote his Representative, Representative Gagliardi, and neither did Judge Hansen. Judge Hansen, who is the president of the Northern Michigan Judges Association, came to the Senate Judiciary Committee representing 53 counties--53 counties out of the 83 counties of this state, and the circuit court judges that serve on those counties. Almost all of the counties were northern counties; the counties of Bay, Wexford, Missaukee, Crawford, Kalkaska, Ostego, Saginaw, Benzie, Manistee, Iosco, Oscoda, Alcona, Alpena, Presque Isle, Gladwin, Clare, Arenac, Ogemaw, Roscommon, Midland, Tuscola, Iron, Montcalm, Antrim, Grand Traverse, Lenawee, Muskegon, Huron, Lake, Mason, Dickinson, Menominee, St. Clare, Sanilac, Mecosta, Marquette, Oceola, Gratiot, Clinton, Macinac, Emmett, Delta, Newago, Oceana, Shiawasee, Alger, Luce, and Schoolcraft, and I probably missed a couple. But, in 53 counties the circuit court judges, through their judicial association, have gone on record in opposition to Senate Joint Resolution R.
One of the most telling things that I thought that occurred in the Senate Judiciary Committee was testimony by Judge Lawrence Root, who is the circuit court judge up in Mecosta County, and I believe that is in the district of the Honorable Senator George McManus. Judge Root, I thought, was excellent. He gave excellent testimony. I don't want to read all of this to you, but just some of the highlights: "I write this letter to reinforce the measure that the one county/one judge principal is unacceptable to myself and my colleagues, and if retained in the proposed constitutional amendment, will result in the active opposition of the Michigan Judges' Association to the amendment."(By the way, that language was retained.)
As for the argument against the one county/one judge concept, there are several, not in any order of priority. The first relates to the family division itself. We all seem to acknowledge that there are a variety of changes that need to be made to save the family division, including amending the Constitution to eliminate the constitutional status of the probate courts. That is easily done. Assuming that such is done to go further and to go to a one county/one judge system, will, in fact, completely destroy the family division in the majority of courts in this state because the one judge in those courts will be required to handle all the cases now heard by the circuit and probate courts, including family cases. While the concept of one family/one judge will be served because there is only one judge, the goal of providing a dedicated forum to handle and give appropriate priority to family cases will be lost. The family cases will just be among the many case types competing for the judge's time and attention. Also, the objective of having a bench with particular dedication, expertise, and commitment to family cases will not be served for the same reasons. In fact, the situation of family cases may be even worse than before because the judge will be handling an even broader range of cases than was handled before all of the circuit and probates are joined in one court.
To save the family division but destroy its benefit to so many of our citizens is incredulous to say the least. In effect, Judge Root was saying that if we create this family division, we will destroy the harmony that many of the multi-county circuits are currently enjoying. If you're wondering how many multi-county circuits we have in Michigan, out of the 83 counties, we have 15 multi-circuit counties. Primarily those counties are in Senators Koivisto's, North's, McManus', Schuette's, and Emmons' Districts. In all of those counties we will, in effect, destroy the harmony that they presently have operating between the probate and circuit court judges. By mandating that the new circuit court judges that we create out of the probate court have to handle the family docket, we, in effect, say that each one of these judges will have to handle all of the cases within their particular county. That's the same position that Judge Root is taking and the same position that Judge Root has put before this body.
I am particularly chagrined at how this has developed in the Michigan Senate. We have had a rush to judgment and we are poised to eliminate a constitutional court, the probate court in this state, in order to continue to create the family court division of circuit court. We have done that; it is unnecessary to do this constitutional amendment. We could finish off the creation of the family court by statutory changes. This is not the way to go. This is not what we need to be putting on the table, and I would hope the members of this body will vote "no" on SJR R.
Senator V. Smith's second statement, in which Senator Young concurred, is as follows:
Mr.President and members, I find interesting the chairperson's argument about 50 or 60 cases for the part-timers, yet at the same time, he wants to include language which would require one judge in each county. In Mecosta County there are 15,000 people. If he thinks the new circuit court judge that we elect from Mecosta County for 15,000 people is going to have a full docket, then I'd say that he's mistaken, and I'd say that that judge will, in effect, be sent over to Alpena or a more populous county, and he will be hearing cases in a county in which he was not elected.
Oh, by the way, that does remind me, I thought that was the same argument that the chairperson used in the elimination of recorder's court was having judges making decisions over people who they were not elected by. That's the same thing that will happen in the multi-circuits with the election of one judge per county and the judge being able to serve every jurisdiction within the multi-circuit. So, you know, apples and oranges.
I also listened as he made his arguments about the Michigan Judges Association. I thought, and the chairperson would remind you, I also voted against their suggestion in the Senate Judiciary Committee. We weren't going to give them lifetime appointments. But the judges do make a point, and their point is that once we require one judge per county, we, in effect, create the same problem that he's trying to eliminate with the part-time judges--not enough work. And those judges, in effect, will now be assigned by the Supreme Court, and they will be moved into other parts of that circuit court jurisdiction or, indeed, in other parts of the state in order to have enough judicial work for them to justify their salaries. So we don't eliminate the problem; we perpetuate the problem. That is the point that the Michigan judges were making--that we perpetuate the problem by putting in the constitutional language that still requires every county to at least be able to elect one judge. And those small counties, when the judge doesn't have enough work to do, will be assigned to a larger county.
I would hope that you would not be convinced that the chairperson has done his homework on this one. The probate courts have been in effect and in existence in this state for over 130 years. We have not seen a thorough, thought-out, on-going review as to the need to eliminate the probate court. There is no need to eliminate the balance of the probate court to create the family court division. I heard the chairperson say, "Well, we have to do that because the probate court is a constitutional court." Well, if we wanted to eliminate the probate court, I agree with him. We do have to have a constitutional amendment. But if we want to create the family court division, which we did by statute, we can also send the probate judges that handled the juvenile division over to the family division just like we did with the abolition of the recorder's court, and we can do that by statute. You do not have to vote to eliminate the balance of the probate court in order to create this family court division.
And for my northern Michigan colleagues where your judges are almost in lock-step against it, where they're in lock-step against the concept of one judge per county, where they're in lock-step against the idea that the changes that you are putting on the table will destroy the working relationships that they presently have going, I would hope that you would pay some attention. And I would also hope that you would pay some attention to the more populous, urban districts where 80,000 guardianships are filed in Wayne County--80,000 guardianships. They're handled by a specialized probate judge who wanted to do that docket, who wanted to make sure that your mother was being protected or your aunt was being protected or your uncle or your grandfather was being protected. If you roll that into the circuit court, they aren't going to have the same attention. They're going to get shunted to the side, and the family court is going to end up being the court where nobody wants to serve. Leave the probate court in tact. Let the probate court and the judges of that court carry out their constitutionally elected responsibility. Vote "no" on Senate Joint Resolution R.

A resolution honoring Paul M. Tarr, Jr.
Whereas, It is with great pleasure and privilege that we acknowledge the leadership of Paul M. Tarr, Jr., as he brings to a close a career in state government which has spanned more than three decades. He is deserving of our gratitude and praise for his contributions to the people of the state of Michigan. With the commitment Paul Tarr has given to our state, he has exhibited the highest standards of citizenship and unselfishness. We join with his family, colleagues, and friends in honoring him during a special celebration on Wednesday, May 27, 1998; and
Whereas, The state of Michigan has been most fortunate to have had Paul Tarr in its service. His career has included several different responsibilities. Since 1995, Paul has served as the Legislative Liaison on Appropriations for the Michigan Department of Community Health. For 21 years, he served as Liaison with the Governor's office and the Michigan Legislature on matters pertaining to mental health legislation and the annual departmental budget. For 11 years, Paul served as a regional office manager for the Crippled Children's Commission in a multi-county area in mid-Michigan. He served as Director of the Office of Legal and Legislative Affairs for the Michigan Department of Mental Health for 20 years. He also served as Special Projects Director for the Department of Public Health from 1970-1974. In addition, since 1974, Paul has developed curriculum and conducted workshops for the training of social workers, psychiatric nurses, psychiatrists, judges, probate court staff, and law enforcement offices in mental health law and the implementation of the Michigan Mental Health Code; and
Whereas, Paul is an outstanding, compassionate, committed, valued, and dedicated person, who has been a strong advocate for persons who are developmentally disabled and persons with mental illness. Paul has a deep understanding of governmental infrastructure and always has the time to help those who are in need. The citizens of the state of Michigan are better off because of his years of dedicated service. As Paul's career comes to a close, may he know of our deep appreciation for his long service and valuable contributions; now, therefore, be it
Resolved by the Senate, That a unanimous accolade of praise and tribute be hereby accorded to Paul M. Tarr, Jr., in recognition of his outstanding service to the state of Michigan; and be it further
Resolved, That a copy of this resolution be transmitted to Mr.Tarr as evidence of our admiration and esteem and with our warmest wishes for health and happiness in the years ahead.

A resolution honoring Dominic A. D'Annunzio to wish him well upon his retirement from the Michigan Insurance Bureau.
Whereas, It is most appropriate to join with his colleagues and friends in honoring Dominic D'Annunzio, who is retiring after 2812 years of service to the state of Michigan. Mr.D'Annunzio's successful career is clearly marked by his dedication, integrity, and professionalism; and
Whereas, Dominic D'Annunzio was born in Wyandotte, Michigan, on April 1, 1938, graduated from St. Patrick High School in 1956, and graduated from Walsh College in Troy, Michigan, in 1969, with a degree in accounting after having served honorably in the U.S. Army. Mr.D'Annunzio married his wife, Rosalie, in 1961 and has raised four sons; and
Whereas, During the early part of his civil service career, Dominic was instrumental in the implementation of the Medicaid program transition from Blue Cross Blue Shield of Michigan to the Department of Social Services. In 1973, Dominic established the Medicaid Monitoring Process for the Department of Public Health, a state-of-the-art computer system to identify and review payments to providers to eliminate fraud against the Medicaid program; and
Whereas, Mr.D'Annunzio joined the Insurance Bureau in 1974 as Assistant Commissioner in charge of the Office of Health Insurance. In this role, he oversaw the regulation of Blue Cross Blue Shield of Michigan, Delta Dental of Michigan, health maintenance organizations, and other innovative health delivery systems. He was appointed Deputy Commissioner in January 1987, and as such played an important role in positioning the Insurance Bureau to receive its accreditation status from the National Association of Insurance Commissioners. In 1989, Dominic was appointed by the Commissioner of Insurance to an acting manager role at the Michigan State Accident Fund, which had been designated an agency of state government. He served in this capacity until December 1989; and
Whereas, Dominic A. D'Annunzio, during his tenure as Deputy Commissioner, was twice honored by Governor John Engler by requesting that he serve as Acting Commissioner - the first time in January of 1991, and most recently, from August 1997 until May 1998; now, therefore, be it
Resolved by the Senate, That we offer our warmest congratulations to Mr.Dominic A. D'Annunzio as he retires from the Insurance Bureau of the state of Michigan. May he always know of our respect, appreciation, and admiration; and be it further
Resolved, That a copy of this resolution be transmitted to Mr.D'Annunzio as evidence of our best wishes for health, happiness, and ample time to enjoy and pursue his own pleasures.

Whereas, Academic success depends upon the active participation of parents and guardians working closely with teachers and all school personnel. There is no tool more important to education than strong communication between home and school, regardless of the talent of the teacher or the availability of the finest resources; and
Whereas, It is imperative that every effort be made to foster parental involvement, especially in making it as convenient as possible for parents and guardians to attend conferences with teachers. Parent-teacher conferences cannot be restricted to after-school hours, but must be offered in evenings to accommodate working families. When circumstances require greater flexibility, public schools ought to provide alternate arrangement to find time for parents to meet with teachers; and
Whereas, While most schools and teachers do all they can to encourage parental participation at conferences, it is appropriate to remove as many obstacles as possible to full attendance at parent-teacher conferences in our state; now, therefore, be it
Resolved by the Senate, That we urge all public schools to encourage full participation in parent-teacher conferences by ensuring that periods are available for parent-teacher conferences to be scheduled after 5:00p.m. and by providing for alternate arrangements to accommodate parents unable to participate during normal conference times.
