"An act to provide a system of public instruction and elementary and secondary schools; to revise, consolidate, and clarify the laws relating to elementary and secondary education; to provide for the organization, regulation, and maintenance of schools, school districts, public school academies, and intermediate school districts; to prescribe rights, powers, duties, and privileges of schools, school districts, public school academies, and intermediate school districts; to provide for the regulation of school teachers and certain other school employees; to provide for school elections and to prescribe powers and duties with respect thereto; to provide for the levy and collection of taxes; to provide for the borrowing of money and issuance of bonds and other evidences of indebtedness; to establish a fund and provide for expenditures from that fund; to provide for and prescribe the powers and duties of certain state departments, the state board of education, and certain other boards and officials; to provide for licensure of boarding schools; to prescribe penalties; and to repeal acts and parts of acts,".

Protests

 

 

Senators Cherry and A. Smith, under their constitutional right of protest (Art. 4, Sec. 18), protested against the passage of House Bill 4241.

Senator Cherry's statement, in which Senator A. Smith concurred, is as follows:

I voted "no" on House Bill No. 4241, not that I was opposed to the original purpose of this bill. In fact, it's part of this package in which we are attempting to deal with school violence, and I think that's a commendable purpose. I think the bill potentially fit into that, but ultimately, the bill was hijacked for another purpose, and that's to deal with some problems surrounding the organization of the Detroit schools under this new reform board in their efforts to select an interim CEO.

It strikes me that the problem the board got into was created by language we initially put in the act that allowed someone to exercise a veto. By golly, someone chose to exercise that option. So now we're back saying, "Well, we didn't mean that. You're not going to be able to exercise that veto," except we're leaving in this bill provisions for one board member and one board member only to have the ability to exercise a veto. Now that's just plain, straight-out power politics and sends a message to that community that you can do what you think is right in organizing your schools, unless the Governor of this state disagrees with you. Then you have to go back to the drawing board because his member of the board is the only one with a veto.

You know, it was that political attitude that caused this problem initially. Who would have thought the other member of the board would exercise that option? That was the kind of arrogance behind that initial language. What we've done, though, is we've kind of unmasked that arrogance and put it straight-out forward for everyone to see, and on that basis, I think we're not serving that reform board well. We're not serving the Detroit community well. We're better off allowing every board member an equal voice--not have someone who's more equal than the rest. They all ought to have an equal voice. That interim CEO ought to be chosen by a majority. On that basis, Mr. President, I could not vote for House Bill No. 4241 as it stands before us right now.
