FALSE REPORTS OF CHILD ABUSE

House Bill 4107

Sponsor: Rep. Andrew Raczkowski

Committee: Criminal Law and Corrections

Complete to 2-12-99

A SUMMARY OF HOUSE BILL 4107 AS INTRODUCED 1-28-99

The bill would amend the Child Protection Law to unify the penalty provided for knowingly making a false report of child abuse or neglect. Current law varies the penalty depending upon the type of crime falsely reported -- if the alleged crime is a misdemeanor, the person making the report is guilty of a misdemeanor; if the reported crime is a felony, the person who made the false report is guilty of a felony. The bill would make any false report a felony and provide a penalty of no more than one year in prison, a fine of no more than $10,000, or both.
