House Bill 4995 would amend two sections of the Michigan Vehicle Code to specify that blocking a wheelchair ramp would be a civil infraction, and to allow local police to remove a vehicle for such a violation at the owner's expense.
Under current law, a police agency (or a governmental agency designated by the police) may remove a vehicle from public or private property at the expense of the owner if the vehicle is stopped, standing, or parked in a space designated as parking for people with disabilities. House Bill 4995 also would allow removal of the vehicle when it is stopped, standing, or parking in an access aisle or lane immediately adjacent to parking that is designated for people with disabilities, or when it is parked in front of a ramp or a curb-cut in such a manner as to block access to a disabled person in a wheelchair.
Further, current law prohibits a vehicle from being parked in a parking space clearly identified by an official sign as being reserved for use by people with disabilities unless the vehicle displays a certificate of identification, windshield placard, special registration plate, or tabbed special registration plate. House Bill 4995 also would prohibit a vehicle from being parked in an access aisle or space immediately adjacent to a parking space of this kind, or in front of a ramp or a curb-cut in such a manner as to block access to a disabled person in a wheelchair.
