A SUMMARY OF HOUSE BILL 5258 AS INTRODUCED 2-1-00

House Bill 5258 would add a new part, Part 332, to the Natural Resources and Environmental Protection Act to regulate radioactive materials. The bill would specify that mixed oxide material could not be transported on a bridge over -- or a tunnel under -- the Great Lakes, or their connecting waterways. Further, under the bill, a violation of this provision would be a felony, punishable by a fine of up to $1 million, imprisonment for up to one year, or both.

The bill would define certain terms as follows:

"Connecting waterway" would mean any portion of the waters of the St. Marys River, the St. Clair River, Lake St. Clair, or the Detroit River, over which the state had jurisdiction.

"Great Lakes" would be defined under the bill to mean any portion fo the waters of Lake Superior, Lake Michigan, Lake Huron, or Lake Erie, over which the state had jurisdiction.

Mixed oxide material" would mean a mixture of plutonium and depleted uranium for use as fuel in a nuclear reactor.
