A SUMMARY OF HOUSE BILL 5916 AS INTRODUCED 6-21-00


The Worker's Disability Compensation Act of 1969 currently makes unemployed disabled workers ineligible for wage loss benefits under the act if they receive, and refuse, a bona fide offer of "reasonable employment." The bill would add that a bona fide offer of reasonable employment would have to remain available for a "reasonable" period of time.


In addition, if disability is established under the act, a worker currently receives compensation based upon his or her wage at the original date of injury if, for whatever reason, he or she loses her job after having been employed under this subsection of the act for less than 100 weeks. The bill would strike "for whatever reason," and instead insert "through no fault of the employee."
