CONTENT
The bill would amend Motor Carrier Act to require that assessments collected for violations be deposited in the General Fund and allocated to the Department of State Police, Motor Carrier Division, instead of being deposited in the Truck Safety Fund.
Under the Act, a person or motor carrier may be subject to a maximum assessment of $500 for each violation of the Act, a rule promulgated or an order issued pursuant to the Act, or a term or condition of a certificate of permit.

FISCAL IMPACT
The bill would have an indeterminate fiscal impact on the Department of State Police (MSP). The bill would redirect a portion of the funds which currently go to the Truck Safety Fund, to the Motor Carrier Division of the MSP.
Under current law, the Truck Safety Fund is composed of three fund sources: $15 of the registration fee collected by the Department of Consumer and Industry Services (DCIS) on most large trucks, interstate truck registration fees collected by the DCIS, and truck assessments collected by the DCIS for violations of the Motor Carrier Act. The amount of the fee money earmarked for the Truck Safety Fund would amount to 90% of whatever amount exceeded $1.4 million in collections in a given year.
The Truck Safety Fund serves as a funding source for the truck safety commission within MSP Office of Highway Safety Planning. The Commission transfers a portion of the truck safety funds to the Motor Carrier Division of MSP to fund special transportation enforcement team operations.
