CONTENT


The bill would amend the Revised Judicature Act to prohibit a person from bringing a civil action for damages for daily living, medical, educational, or other expenses necessary to raise a child to the age of majority, whether labeled wrongful birth or wrongful pregnancy, or under some other title or theory.


The bill's prohibition would apply regardless of whether the child was born healthy or with a birth defect or other adverse medical condition. The prohibition would not apply to a civil action for damages for an intentional or grossly negligent act or omission including an act or omission that violated the Michigan Penal Code.


The bill states: "The law of this state is that the benefits of a child's life always outweigh the cost of raising the child."
