HOUSE BILL No. 4973 October 7, 1999, Introduced by Rep. Jamnick and referred to the Committee on Education. A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1310a (MCL 380.1310a), as added by 1999 PA 102. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1310a. (1) At least annually, each school board shall 2 prepare and submit to the superintendent of public instruction, 3 in the form and manner prescribed by the superintendent of public 4 instruction, a report stating the number of pupils expelled from 5 the school district during the immediately preceding school year, 6 with a brief description of the incident that caused each 7 expulsion. 8 (2) THE SUPERINTENDENT OF PUBLIC INSTRUCTION SHALL ANALYZE 9 THE INFORMATION SUBMITTED UNDER SUBSECTION (1) AND, AT LEAST 10 ANNUALLY, SHALL SUBMIT A REPORT TO THE LEGISLATURE ON THE RESULTS 04185'99 TAV 2 1 OF THE ANALYSIS AND ON ANY RECOMMENDATIONS FOR STATUTORY CHANGES 2 OR OTHER POLICY ACTIONS THAT SHOULD BE TAKEN AS A RESULT. THIS 3 ANALYSIS SHALL INCLUDE AT LEAST ALL OF THE FOLLOWING: 4 (A) CAUSES FOR PUPIL EXPULSIONS. 5 (B) DEMOGRAPHIC DATA CONCERNING EXPELLED PUPILS. 6 (C) TRENDS CONCERNING THE TYPES OF INCIDENTS OR PUPILS 7 INVOLVED. 8 (D) OTHER INFORMATION THAT WOULD AID IN UNDERSTANDING AND 9 LIMITING BEHAVIOR THAT RESULTS IN EXPULSIONS AND THAT WOULD FUR- 10 THER THE GOALS SPECIFIED IN SUBSECTION (3)(A) TO (D). 11 (3)(2)In order to obtain an accurate local and statewide 12 picture of school crime and to develop the partnerships necessary 13 to plan and implement school safety programs, at least annually, 14 each school board shall report to the superintendent of public 15 instruction, in the form and manner prescribed by the superinten- 16 dent of public instruction, incidents of crime occurring at 17 school within the school district. In determining the form and 18 manner of this report, the superintendent of public instruction 19 shall consult with local and intermediate school districts and 20 law enforcement officials. The reporting shall include at least 21 crimes involving physical violence, gang-related activity, ille- 22 gal possession of a controlled substance or controlled substance 23 analogue, or other intoxicant, trespassing, and property crimes 24 including, but not limited to, theft and vandalism. For a prop- 25 erty crime, the report shall include an estimate of the cost to 26 the school district resulting from the property crime. The 04185'99 3 1 school crime reporting requirements of this subsection are 2 intended to do all of the following: 3 (a) Help policymakers and program designers at the local and 4 state levels develop appropriate prevention and intervention 5 programs. 6 (b) Provide the continuous assessment tools needed for 7 revising and refining school safety programs. 8 (c) Assist schools and school districts to identify the most 9 pressing safety issues confronting their school communities, to 10 direct resources appropriately, and to enhance campus safety 11 through prevention and intervention strategies. 12 (d) Foster the creation of partnerships among schools, 13 school districts, state agencies, communities, law enforcement, 14 and the media to prevent further crime and violence and to assure 15 a safe learning environment for every pupil. 16 (4)(3)At least once each semester, each school board 17 shall provide a copy of the most recent report under subsection 18(2)(3) available for the school district to the parent or 19 legal guardian of each pupil enrolled in the school district. 20 (5)(4)As used in this section, "school board" and 21 "school district" mean those terms as defined in section 1310. 04185'99 Final page.
