HOUSE BILL No. 4998 October 14, 1999, Introduced by Rep. Callahan and referred to the Committee on Agriculture and Resource Management. A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 11701 (MCL 324.11701) and by adding section 11712a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 11701. As used in this part: 2 (a) "Certified health department" means a city, county, or 3 district department of health to which the director has delegated 4 the authority to perform activities as prescribed by this part. 5 (b) "Cesspool" means a cavity in the ground that receives 6 waste to be partially absorbed directly or indirectly by the sur- 7 rounding soil. 8 (C) "DEPARTMENT" MEANS THE DEPARTMENT OF ENVIRONMENTAL 9 QUALITY. 04085'99 JCB 2 1 (D)(c)"Governmental unit" means a county, township, 2 municipality, or other regional authority. 3 (E)(d)"Injection" means the pressurized placement of 4 septage waste below the surface of soil. 5 (F)(e)"Motor vehicle" means a vehicle that is 6 self-propelled and used to transport septage waste. 7 (G)(f)"Peace officer" means every sheriff or sheriff's 8 deputy, village or township marshal, officer of the police 9 department of any city, village, or township, any officer of the 10 Michigan state police, any peace officer who is trained and cer- 11 tified pursuant to theMichigan law enforcement officers train-12ing council act of 1965, Act No. 203 of the Public Acts of 1965,13being sections 28.601 to 28.616 of the Michigan Compiled Laws14 COMMISSION ON LAW ENFORCEMENT STANDARDS ACT, 1965 PA 203, MCL 15 28.601 TO 28.616, or any conservation officer appointed by the 16 department pursuant to section6 of Act No. 192 of the Public17Acts of 1929, being section 300.16 of the Michigan Compiled Laws18 1606. 19 (H)(g)"Portable toilet" means a receptacle for human 20 waste temporarily in a location for human use. 21 (I)(h)"Public septage waste treatment facility" means a 22 septage waste or other wastewater treatment facility owned and 23 operated by a governmental unit and approved by the department 24 for treating septage waste. 25 (J)(i)"Seepage pit" means a dry well, leaching pit, or 26 any other cavity in the ground that receives the liquid discharge 27 of a septic tank. 04085'99 3 1 (K)(j)"Septage waste" means any human excrement, other 2 domestic or restaurant waste, or other material or substance 3 removed from a portable toilet, septic tank, seepage pit, cess- 4 pool, sewage lift station, or other enclosure as determined by 5 the department IN RULES PROMULGATED under section 11718, but does 6 not include liquid industrial waste regulated under part 121. 7 (l)(k)"Septic tank" means a septic toilet, chemical 8 closet, or other enclosure used for the storage or decomposition 9 of septage waste. 10 (M)(l)"Service" or "servicing" means cleaning, removing, 11 transporting, or disposing of septage waste from a portable 12 toilet, septic tank, seepage pit, cesspool, sewage lift station, 13 or other enclosure as determined by the department IN RULES 14 PROMULGATED under section 11718. 15 (N)(m)"Sewage lift station" means a pumping facility 16 that lifts septage waste to a higher elevation. 17 (O)(n)"Site" means a location that has been approved by 18 the department as a suitable location for the disposal of septage 19 waste. 20 (P)(o)"Tank" means a container placed on a motor vehicle 21 to carry or transport septage waste. 22 SEC. 11712A. BEGINNING ON THE EFFECTIVE DATE OF THIS SEC- 23 TION, A PERSON HOLDING A SEPTAGE WASTE SERVICING LICENSE UNDER 24 THIS PART SHALL REPORT TO THE DEPARTMENT THE LOCATION WHERE EACH 25 LOAD OF SEPTAGE WASTE HAS BEEN DISPOSED.
