A bill to amend 1991 PA 179, entitled "Michigan telecommunications act," by amending section 201 (MCL 484.2201) and by adding section 214. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 201. (1) The Michigan public service commission shall 2 have the jurisdiction and authority to administer this act AND 3 ALL FEDERAL TELECOMMUNICATIONS LAW, RULES, ORDERS, AND POLICIES 4 THAT ARE DELEGATED TO THE STATE. 5 (2) In administering this act, the commission shall be 6 limited to the powers and duties prescribed by this act. 7 SEC. 214. (1) THE COMMISSION SHALL INVESTIGATE AND DETER- 8 MINE THE NEED AND MECHANISM FOR FINANCIAL SUPPORT TO BE PROVIDED 9 TO CUSTOMERS OR PROVIDERS TO ENSURE THE UNIVERSAL AVAILABILITY 04981'99 SAT 2 1 AND AFFORDABILITY OF BASIC LOCAL EXCHANGE SERVICE AND TOLL ACCESS 2 SERVICE. 3 (2) ALL PROVIDERS OF REGULATED AND UNREGULATED TELECOMMUNI- 4 CATIONS SERVICES IN THIS STATE SHALL PROVIDE TO THE COMMISSION 5 ALL INFORMATION NECESSARY TO MAKE THE DETERMINATION UNDER 6 SUBSECTION (1). THE INFORMATION SHALL BE PROVIDED IN SUCH FORM 7 AS REQUESTED BY THE COMMISSION. 8 (3) THE COMMISSION SHALL INITIATE THE INVESTIGATION NO LATER 9 THAN JANUARY 1, 2000, AND ISSUE ITS INITIAL ORDER NO LATER THAN 10 SEPTEMBER 1, 2000. IF A NEED FOR ADDITIONAL FINANCIAL SUPPORT IS 11 DETERMINED, THE COMMISSION SHALL ALSO ESTABLISH THE PROCEDURES BY 12 WHICH THE ADDITIONAL SERVICES ARE PROVIDED, THE LEVEL OF SUPPORT 13 TO BE PROVIDED BY ALL TELECOMMUNICATIONS PROVIDERS, THE DATE FOR 14 IMPLEMENTATION, AND COST RECOVERY. 15 (4) THE COMMISSION SHALL BY ORDER PERIODICALLY REVIEW, AND 16 ADJUST AS NEEDED, THE SUPPORT ESTABLISHED UNDER THIS SECTION. 17 (5) ANY ORDERS ISSUED UNDER THIS SECTION SHALL NOT INTEN- 18 TIONALLY FAVOR ANY GIVEN PROVIDER, GEOGRAPHIC AREA, OR METHOD OF 19 SERVICE DELIVERY. 04981'99 Final page.
