A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1278 (MCL 380.1278), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1278. (1) In addition to the requirements for accred- 2 itation under section 1280 specified in that section, if the 3 board of a school district wants all of the schools of the school 4 district to be accredited under section 1280, the board shall 5 provide to all pupils attending public school in the district a 6 core academic curriculum in compliance with subsection (3) in 7 each of the curricular areas specified in the state board recom- 8 mended model core academic curriculum content standards developed 9 under subsection (2). IF THE BOARD OF A SCHOOL DISTRICT WANTS 10 THE SCHOOL DISTRICT TO BE ELIGIBLE FOR STATE SCHOOL AID INCENTIVE 00905'99 TAV 2 1 PAYMENTS FOR ADOPTING THE STATE BOARD RECOMMENDED MODEL CORE 2 CURRICULUM CONTENT STANDARDS, THE BOARD SHALL COMPLY WITH SUBSEC- 3 TION (4). The state board model core academic curriculum content 4 standards shall encompass academic and cognitive instruction 5 only. For purposes of this section, the state board model core 6 academic curriculum content standards shall not include atti- 7 tudes, beliefs, or value systems that are not essential in the 8 legal, economic, and social structure of our society and to the 9 personal and social responsibility of citizens of our society. 10 (2) Recommended model core academic curriculum content stan- 11 dards shall be developed and periodically updated by the state 12 board, shall be in the form of knowledge and skill content stan- 13 dards that are recommended as state standards for adoption by 14 public schools in local curriculum formulation and adoption, and 15 shall be distributed to each school district in the state. The 16 recommended model core academic curriculum content standards 17 shall set forth desired learning objectives in math, science, 18 reading, history, geography, economics, American government, and 19 writing for all children at each stage of schooling and be based 20 upon the "Michigan K-12 program standards of quality" to ensure 21 that high academic standards, academic skills, and academic 22 subject matters are built into the instructional goals of all 23 school districts for all children. The state board also shall 24 ensure that the Michigan educational assessment program and the 25 high school proficiency exam are based on the state recommended 26 model core ACADEMIC curriculum content standards, are testing 27 only for proficiency in basic academic skills and academic 00905'99 3 1 subject matter, and are not used to measure pupils' values or 2 attitudes. 3 (3) The board of each school district, considering academic 4 curricular objectives defined and recommended pursuant to subsec- 5 tion (2), shall do both of the following: 6 (a) Establish a core academic curriculum for its pupils at 7 the elementary, middle, and secondary school levels. The core 8 academic curriculum shall define academic objectives to be 9 achieved by all pupils and shall be based upon the school 10 district's educational mission, long-range pupil goals, and pupil 11 performance objectives. The SUBJECT TO SUBSECTION (4), THE 12 core academic curriculum may vary from the RECOMMENDED model core 13 academic curriculum content standards recommended by the state 14 board pursuant to subsection (2). 15 (b) After consulting with teachers and school building 16 administrators, determine the aligned instructional program for 17 delivering the core academic curriculum and identify the courses 18 and programs in which the core academic curriculum will be 19 taught. 20 (4) A SCHOOL DISTRICT THAT ADOPTS THE STATE BOARD RECOM- 21 MENDED MODEL CORE CURRICULUM CONTENT STANDARDS DEVELOPED UNDER 22 SUBSECTION (2) MAY BE ELIGIBLE FOR STATE SCHOOL AID INCENTIVE 23 PAYMENTS UNDER THE STATE SCHOOL AID ACT OF 1979, 1979 PA 94, MCL 24 388.1601 TO 388.1772. TO BE ELIGIBLE FOR THIS INCENTIVE PAYMENT, 25 THE BOARD OF A SCHOOL DISTRICT SHALL SUBMIT TO THE DEPARTMENT A 26 BOARD-ADOPTED RESOLUTION INDICATING THAT THE SCHOOL DISTRICT HAS 00905'99 4 1 ADOPTED THOSE CONTENT STANDARDS FOR ITS PUPILS AT ALL GRADE 2 LEVELS. 3 (5) (4) The board may supplement the core academic curric- 4 ulum by providing instruction through additional classes and 5 programs. 6 (6) (5) For all pupils, the subjects or courses, and the 7 delivery of those including special assistance, that constitute 8 the curriculum the pupils engage in shall assure the pupils have 9 a realistic opportunity to learn all subjects and courses 10 required by the district's core academic curriculum in order to 11 give all pupils a reasonable opportunity to attain a 12 state-endorsed diploma. A subject or course required by the core 13 academic curriculum pursuant to subsection (3) shall be provided 14 to all pupils in the school district by a school district, a con- 15 sortium of school districts, or a consortium of 1 or more school 16 districts and 1 or more intermediate school districts. 17 (7) (6) To the extent practicable, the state board may 18 adopt or develop academic objective-oriented high standards for 19 knowledge and life skills, and a recommended core academic cur- 20 riculum, for special education pupils for whom it may not be 21 realistic or desirable to expect achievement of novice level or 22 initial mastery of the state board recommended model core aca- 23 demic content standards objectives or of a high school diploma. 24 (8) (7) The state board shall make available to all non- 25 public schools in this state, as a resource for their considera- 26 tion, the RECOMMENDED model core academic curriculum content 27 standards developed for public schools pursuant to subsection (2) 00905'99 5 1 for the purpose of assisting the governing body of a nonpublic 2 school in developing its core academic curriculum. 3 (9) (8) Excluding special education pupils, pupils having 4 a learning disability, and pupils with extenuating circumstances 5 as determined by school officials, a pupil who does not score 6 satisfactorily on the 4th or 7th grade Michigan educational 7 assessment program reading test shall be provided special assist- 8 ance reasonably expected to enable the pupil to bring his or her 9 reading skills to grade level within 12 months. 10 (10) (9) Any course that would have been considered a non- 11 essential elective course under Snyder v Charlotte School Dist, 12 421 Mich 517 (1984), on April 13, 1990 shall continue to be 13 offered to resident pupils of nonpublic schools on a shared time 14 basis. 00905'99 Final page.
