A bill to amend 1966 PA 331, entitled "Community college act of 1966," by amending section 123 (MCL 389.123), as amended by 1980 PA 5. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 123. (1) The board of trustees may: 2 (a) Have the care and custody of the community college prop- 3 erty and provide suitable facilities, sanitary conditions, and 4 medical inspection for the community college of the district. 5 (b)EstablishSUBJECT TO SUBSECTION (2), ESTABLISH and 6 collect tuition and fees for resident and nonresident students. 7 A waiver of tuition shall not be granted by the board, except AS 8 FOLLOWS: 9 (i) The board of trustees may waive tuition for a student 10 participating in a reciprocal agreement for exchange of 07248'00 DAM 2 1 educational services, if the agreement is approved by the state 2 board of education. 3 (ii) The board of trustees may waive tuition for a student 4 who meets the admission requirements of the board and is 60 years 5 of age or older. 6 (c) Establish and maintain or continue a library or museum, 7 which may be separately operated if desired, for the community 8 college, if the board of trustees considers it advisable to 9 establish and maintain or continue a library or museum and to 10 provide for its care and management. 11 (2) IF A COMMUNITY COLLEGE CLOSES OR HAS CLOSED, A STUDENT 12 WHO IS A RESIDENT OF ANY PART OF THE COMMUNITY COLLEGE DISTRICT 13 OF THE CLOSED COMMUNITY COLLEGE THAT IS NOT INCLUDED IN ANOTHER 14 COMMUNITY COLLEGE DISTRICT MAY ATTEND ANY COMMUNITY COLLEGE IN 15 THE COUNTY IN WHICH THE STUDENT RESIDES, AND THAT COMMUNITY COL- 16 LEGE MAY ONLY CHARGE RESIDENT TUITION AND FEES TO THE STUDENT. 17 AS USED IN THIS SUBSECTION, "COMMUNITY COLLEGE DISTRICT" INCLUDES 18 A SCHOOL DISTRICT THAT OPERATES OR FORMERLY OPERATED A COMMUNITY 19 COLLEGE UNDER PART 25 OF THE REVISED SCHOOL CODE, 1976 PA 451, 20 MCL 380.1601 TO 380.1607. 07248'00 Final page.
