A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1104 (MCL 380.1104), as amended by 1995 PA 289. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1104. (1) If less than a majority of the offices of a 2 school districtbecomesBECOME vacant, the remaining members of 3 the board shall fill the vacancy immediately. 4 (2) If a vacancy is not filled within2030 days after it 5 occurs, the intermediate school board shall fill the vacancy by 6 appointment. 7 (3) If a majority of the offices are vacant at the same 8 time, the remaining member or members of the board shall 9 immediately call a special election of the school district to 10 fill the vacancies. If the election is not called by the 03840'99 TAV 2 1 remaining member or members of the board within2030 days 2 afterthe happening ofthe vacancies OCCUR, or if all offices 3 of the members of the board are vacant, the intermediate superin- 4 tendent shall call a special election of the school district to 5 fill the existing vacancies for unexpired portions of the respec- 6 tive terms. The special election shall be heldon a date7approved by the county election scheduling committee under sec-8tion 639 of the Michigan election law, Act No. 116 of the Public9Acts of 1954, being section 168.639 of the Michigan Compiled10LawsAS PROVIDED UNDER THIS ACT AND THE MICHIGAN ELECTION LAW, 11 1954 PA 116, MCL 168.1 TO 168.992. 12 (4) A person elected or appointed to fill a vacancy on the 13 board shall file an acceptance of office and qualify under sec- 14 tion 1102, and shall hold office until the next regular school 15 election when the vacancy shall be filled for the remainder of 16 the unexpired term. 03840'99 Final page.
