Rev. Daniel Wermuth, II, Pastor of the Bethel Family Worship Center in Jackson, offered the following invocation:
"I would like to pray a prayer that David prayed, David the son of Jesse and the King of Israel.
O Lord, You have searched me and known me. You know my sitting down and my rising up; You understand my thought afar off. You comprehend my path and my lying down, and are acquainted with all my ways. For there is not a word on my tongue, But behold, O Lord, You know it altogether. You have hedged me behind and before, and laid Your hand upon me. Such knowledge is too wonderful for me; It is high, I cannot attain it.
Where can I go from Your Spirit? Or where can I flee from Your presence? If I ascend into heaven, You are there; If I make my bed in hell, behold, You are there. If I take the wings of the morning, and dwell in the uttermost parts of the sea, even there Your hand shall lead me, and Your right hand shall hold me. If I say, "Surely the darkness shall fall on me," Even the night shall be light about me; Indeed, the darkness shall not hide from You, But the night shines as the day; The darkness and the light are both alike to You.
For You formed my inward parts; You covered me in my mother's womb. I will praise You, for I am fearfully and wonderfully made; Marvelous are Your works, and that my soul knows very well. My frame was not hidden from You, when I was made in secret, and skillfully wrought in the lowest parts of the earth. Your eyes saw my substance, being yet unformed. And in Your book they all were written, the days fashioned for me, when as yet there were none of them.
How precious also are Your thoughts to me, O God! How great is the sum of them! If I should count them, they would be more in number than the sand; When I awake, I am still with You.
Oh, that You would slay the wicked, O God! Depart from me, therefore, you bloodthirsty men. For they speak against You wickedly; Your enemies take Your name in vain. Do I not hate them, O Lord, who hate You? And do I not loathe those who rise up against You? I hate them with perfect hatred; I count them my enemies.
Search me, O God, and know my heart; Try me, and know my anxieties; And see if there is any wicked way in me, and lead me in the way everlasting.

Second Reading of Bills
House Bill No. 4714, entitled
A bill to amend 1953 PA 232, entitled "An act to revise, consolidate, and codify the laws relating to probationers and probation officers, to pardons, reprieves, commutations, and paroles, to the administration of correctional institutions, correctional farms, and probation recovery camps, to prisoner labor and correctional industries, and to the supervision and inspection of local jails and houses of correction; to provide for the siting of correctional facilities; to create a state department of corrections, and to prescribe its powers and duties; to provide for the transfer to and vesting in said department of powers and duties vested by law in certain other state boards, commissions, and officers, and to abolish certain boards, commissions, and offices the powers and duties of which are transferred by this act; to allow for the operation of certain facilities by private entities; to prescribe the powers and duties of certain other state departments and agencies; to provide for the creation of a local lockup advisory board; to prescribe penalties for the violation of the provisions of this act; to make certain appropriations; to repeal certain parts of this act on specific dates; and to repeal all acts and parts of acts inconsistent with the provisions of this act," by amending section 36 (MCL 791.236), as amended by 1998 PA 315.

1. Amend page 5, line 17, after "DEPARTMENT" by striking out "IMMEDIATELY" and inserting "WITHIN 3 BUSINESS DAYS".

A bill to amend 1974 PA 258, entitled "Mental health code," by amending section 746 (MCL 330.1746) and by adding section 747.
Was read a second time, and the question being on the adoption of the proposed amendment previously recommended by the Committee on Criminal Law and Corrections (for amendment, see House Journal No. 67, p. 1940),
The amendment was adopted, a majority of the members serving voting therefor.
Rep. Faunce moved to amend the bill as follows:
1. Amend page 2, line 13, after "ORDER" by inserting "UNLESS THAT ORDER EXPIRES OR THE MENTAL HEALTH PROFESSIONAL RECEIVES A COPY OF A NEW OR MODIFIED COURT ORDER PERMITTING ACCESS TO THE INFORMATION".
2. Amend page 3, line 2, after "ORDER" by inserting "UNLESS THAT ORDER EXPIRES OR THE FACILITY, LICENSED FACILITY, PSYCHIATRIC HOSPITAL, OR CENTER RECEIVES A COPY OF A NEW OR MODIFIED COURT ORDER PERMITTING ACCESS TO THE INFORMATION".
3. Amend page 3, following line 2, by inserting:
"(3) A MENTAL HEALTH PROFESSIONAL, FACILITY, LICENSED FACILITY, PSYCHIATRIC HOSPITAL, OR CENTER THAT MAKES A REASONABLE EFFORT TO COMPLY WITH SUBSECTION (1) OR (2) IS NOT CIVILLY OR CRIMINALLY LIABLE OR SUBJECT TO A REMEDY OR PENALTY AVAILABLE IN THIS ACT FOR FAILURE TO COMPLY WITH SUBSECTION (1) OR (2).
(4) A HOLDER OF MENTAL RECORDS OR OTHER MENTAL HEALTH CARE INFORMATION PERTAINING TO THE MINOR MAY CHARGE THE PERSON MAKING THE REQUEST FOR RECORDS A REASONABLE AMOUNT TO REDACT INFORMATION IN THE REQUESTED MENTAL HEALTH RECORDS OR INFORMATION.".

A bill to amend 1978 PA 368, entitled "Public health code," (MCL 333.1101 to 333.25211) by adding sections 16290 and 20175a.

1. Amend page 1, line 1, after "SEC. 16290." by inserting "(1)".
2. Amend page 2, line 2, after "ORDER" by inserting "UNLESS THE ORDER EXPIRES OR THE LICENSEE OR REGISTRANT RECEIVES A COPY OF A NEW OR MODIFIED COURT ORDER PERMITTING ACCESS TO THE INFORMATION. A LICENSEE OR REGISTRANT WHO MAKES A REASONABLE EFFORT TO COMPLY WITH THIS SECTION IS NOT CIVILLY OR CRIMINALLY LIABLE OR SUBJECT TO A REMEDY OR PENALTY AVAILABLE IN THIS ARTICLE FOR FAILURE TO COMPLY WITH THIS SECTION".
3. Amend page 2, following line 2, by inserting:

Rep. Vear, having reserved the right to explain his protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
Due to the fact that no consideration has been given to fund MI Trees for the 21st Century HB 4875 and no projects were granted in my district in HB 4310 I am voting no on this $11.5 million of spending by our great state of Michigan."
Rep. Minore, having reserved the right to explain his protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
I have no objection to projects recommended for funding from the Clean Michigan Initiative. I assume that the departments recommendations are sound and are based on reasonable and credible applications.
A cursory review of the recommended projects, however, suggests that urban population centers are not well served by this appropriation. It appears that there is a disproportionate number of projects serving townships, small cities and rural areas--leaving larger population centers under served.
My no vote is intended to remind the Department that the number of PEOPLE served needs to be considered in future reviews and recommendations."

A bill to amend 1935 PA 59, entitled "An act to provide for the public safety; to create the Michigan state police, and provide for the organization thereof; to transfer thereto the offices, duties and powers of the state fire marshal, the state oil inspector, the department of the Michigan state police as heretofore organized, and the department of public safety; to create the office of commissioner of the Michigan state police; to provide for an acting commissioner and for the appointment of the officers and members of said department; to prescribe their powers, duties, and immunities; to provide the manner of fixing their compensation; to provide for their removal from office; and to repeal Act No. 26 of the Public Acts of 1919, being sections 556 to 562, inclusive, of the Compiled Laws of 1929, and Act No. 123 of the Public Acts of 1921, as amended, being sections 545 to 555, inclusive, of the Compiled Laws of 1929," by amending section 6 (MCL 28.6), as amended by 1989 PA 10.

A resolution recognizing October as Domestic Violence Awareness Month in Michigan.
Whereas, The State of Michigan recognizes domestic violence as a tragic epidemic that remains a devastating reality for countless families and individuals; and
Whereas, In the United States an estimated 3 to 4 million women are victims of domestic violence assault each year, with an act of domestic violence occurring every 15 seconds; and
Whereas, The crime of domestic violence violates an individual's privacy, dignity, and security in demeaning ways, in which they are made vulnerable to emotional, physical, psychological, and sexual control and violent abuse; and
Whereas, The House of Representatives of Michigan, along with Governor John Engler who has declared October Domestic Violence Awareness Month, continue to pass some of the toughest domestic violence laws in the nation, which protect the families of our state and hold all abusers accountable for their crimes; and
Whereas, Governor John Engler is to be commended for dedicating this month to bring awareness to this societal problem that plagues too many Michigan families, so that as legislators, citizens, husbands, wives, fathers, mothers, and neighbors, we continue to take a stand and pass the policies that provide for a safe environment in our homes; now, therefore, be it

Whereas, In recent years, our country has made great strides in revamping the entire concept of welfare. Michigan has been especially effective in fostering increased self-sufficiency in tens of thousands of men and women; and
Whereas, Michigan's leadership in encouraging people to work, to pursue valuable training and education, and to escape dependence on public support has been most remarkable. Earlier this year, the Family Independence Agency caseload dropped well below 90,000, to a level Michigan has not seen in more than a generation. Indeed, as recently as 1994, the Family Independence Agency caseload stood at over 225,000; and
Whereas, A key contributor to Michigan's achievements has been its flexibility in developing and implementing programs like Project Zero and the MIChild health insurance program and initiatives to provide meaningful preparation for work. Programs to concentrate resources on target counties and communities have allowed for proper consideration of local situations and needs. This concept has proven to be most successful; and
Whereas, The federal Welfare-to-Work program, established as part of the Balanced Budget Act of 1997, is up for reauthorization. As it is examined, there are several areas that can be modified to provide greater flexibility. Provisions appropriate for change include allowing states to use a greater percentage of in-kind match and to count other federal and state funds, such as TANF and TANF maintenance of effort (MOE), as match; expanding eligibility standards; and changing the way funds are used for education training. These changes can help to bring about even more victories in the lives of individuals and families; now, therefore, be it

Whereas, Mergers and the growth of international corporations in all aspects of agriculture are bringing changes to farming. Along with concerns over the impact on the traditional family farm and the impact on American agriculture, there are many who feel that the huge companies have become so large that a few entities can control the market often enough to eliminate competition. In the current situation, with depressed prices for many commodities in the midst of a robust economy, many farmers and processors worry about what will happen in the next downturn; and
Whereas, The strength of American agriculture is critical to the long-term best interests of our nation. For agriculture to thrive, the market must be fair. Faith in the system of determining prices cannot endure the threat that antitrust protections are being violated; now, therefore, be it

Whereas, Amidst an era of unprecedented economic strength and consistent growth, American agriculture is facing significant and lasting problems. This fact is reflected not only in very low commodity prices, but also by the number of farms. A steady trend seems to indicate a continuing decline in the number of farms and a marked increase in the role of corporations in farming in parts of the country; and
Whereas, With a greater number of corporate conglomerates and mergers in the agriculture industry, more pressure is being exerted upon individual family farms. In certain sectors of the farm economy, giant companies make it almost impossible for traditional farms to succeed; and
Whereas, Many observers have questioned the continuing disparity between the prices paid for some agricultural products to the farmers and the price of the product as it enters the marketplace. While prices for many commodities are very low and have decreased considerably in the recent past, there seems to be little correlating reductions in the costs for consumers. This situation can be addressed through requirements for price reporting. Requiring a meat packing company, for example, to report publicly the price it paid for livestock would promote fairness. There have been several legislative proposals to make price reporting a requirement in order to increase accountability in a vital segment of our national economy; now, therefore, be it
