Local Government Claims Review Board
1998 ANNUAL REPORT
The Local Government Claims Review Board was established by Public Act No. 101 of 1979. It was given the duty of implementing Section 29 of Article IX of the Constitution of 1963. This is the portion of the Headlee amendment to the Constitution which concerns state requirements of local units and reimbursement for costs of those requirements.
Actions of the Board: The Board has begun holding meetings, employed staff and taken action on documents and procedures essential to its mission such as a claim form and work plan.
The Board met in July, 1998 for an organizational meeting. At the meeting, it also approved the dismissal of several claims from school districts. These districts had agreed to this action as part of the overall resolution to the long-standing Durant lawsuit concerning funding of special education and other programs.
The Board met again in December, 1998. At this meeting it discussed the claim form which local units will use in presenting their claims to the Board. It also discussed a work plan for the process it will follow in specifically responding to inquiries or claims. It also heard a report from the Attorney General staff on legal issues surrounding the Headlee amendment and the role of the Board.
Claims and letters of inquiry: The Board is obligated to report its actions on claims to the legislature. At this point, there is one correspondence pending which may lead to a claim. Bay County has asked for a claim form to start the process for a review of costs of implementing the qualified voter file for its voters. The request came in mid-December. At the time of this report, February of 1999, there has been no reply to the claim form which was sent to Bay County.
There are a number of old letters of inquiry on a variety of subjects from 1979 to 1987. Many were responded to at the time of receipt. The Board reviewed the others, and is presently contemplating its response to the remaining few.
1999 ANNUAL REPORT
Submitted pursuant to the requirements of Sec. 21.240 (8) of the Michigan Complied Laws
The Local Government Claims Review Board was established by Public Act No. 101 of 1979. This act was part of the implementation of Section 29 of Article IX of the Constitution of 1963. This language was added to the Constitution by voters as part of the 1978 tax limitation amendment commonly referred to as the "Headlee" amendment.
Annual Report: Sec. 10 (8) of Public Act No. 101 pf 1979 makes the following requirement of the Board:
"Before January 31 of each year, the board shall report to the legislature and the governor on the number and amount of the claims the board has approved or rejected on appeal pursuant to this section."
This report is provided to satisfy that requirement.
Activities of the Board: In summary, the Board held a number of meeting to discuss and approve a claim form for local units to use, a work plan to govern its handling of specific claims and attempted to address past inquiries. It also processed and dismissed a formal claim from a local unit of government.
Past inquiries: The Board received reports on past inquiries to the state from its executive secretary and legal counsel from the Department of Attorney General. Because of the long period of inaction prior to 1998, there had been approximately two dozen past inquiries on file from local units of government. None of these were officially deemed "claims" because they did not meet specific fundamental tests.
The Board determined that while many of the inquiries had been appropriately responded to by past state officials or employees, a small number did not appear to have any state response. The Board directed its executive secretary to contact these few local units to determine if they desired to pursue the old inquiry or begin a formal claim.
Mecosta County Prosecutor's Office: The current Mecosta County Prosecutor was contacted in April to indicate his predecessor had written a letter in 1985 concerning implementation costs of the "Crime Victims Rights" legislation. Correspondence from the Mecosta County Prosecutor only indicated an estimated cost "...in excess of Ten Thousand ($10,000.00) Dollars.".
Legal research indicated that this issue was addressed in 1989 Op.Att.Genl No. 6576, pp. 72-77. The present Mecosta County Prosecutor was notified that the Board would administratively dismiss the inquiry. He was offered the opportunity to present objections to that dismissal, but replied with correspondence indicating he would not do so. The Board did administratively dismiss this inquiry at its April 30, 1999 meeting.
City of Pontiac: The City of Pontiac had inquired in 1984 about costs related to its Collier Road landfill. The letter from the City of Pontiac listed costs for the landfill at $1,112,417.59. The letter also stressed that costs were ongoing, and they planned to "up-date this statement periodically".
Legal research by the Department of Attorney General established that the issue raised by Pontiac had been addressed in the case of Livingston County v Department of Management and Budget, 430 Mich 635 (1988). The City of Pontiac was notified that in light of the court case cited, the Board would administratively dismiss the inquiry. The City of Pontiac did not respond to this notice. The Board did administratively dismiss this inquiry as its April 30, 1999 meeting.
New claims: The Board devoted much of its time to establishing the process for handling claims in 1999. The Board's executive secretary was contacted by a number of local units regarding claims, and what paperwork was necessary to begin the process. These local units were sent the materials in question. The City of Westland formally submitted a claim to the Board.
City of Westland: The City of Westland began the process of submitting a claim with a letter to the Board in July, 1999. The City of Westland sought to have the state supply funding for voting machines because of statutory requirements for a minimum number of voting devices per registered voters. Westland supplied information for numerous purchases totaling $74,650.
The City of Westland was sent a claim form which was subsequently returned to the Board. The response to the claim form indicated a lack of clarity in some of the form's language. The Board discussed amendments to the form at its September meeting. The City of Westland was asked for additional information. Additional information was delivered on October 19, 1999.
On November 12, 1999, the City of Westland was notified by Chair Steinborn that, based on the information received, he would recommend that the Board administratively dismiss the claim at its November 19, 1999 meeting. The City of Westland responded with a last communication, but the Board did not find that compelling.
At the November 19, 1999 meeting, the Board heard comments from Mr. Brian Devlin of the Department of Attorney General on numerous and significant issues and defects in the claim. Mr. Devlin had earlier supplied the Board with an extensive brief on behalf of the Department of State and State Budget Director Mary Lannoye.
Following Mr. Devlin's comments, the Board voted to dismiss the claim from the City of Westland.
Approved claims: The provisions of Sec. 21.240 (8) of the Michigan Complied Laws require the Board to report to the Legislature and Governor on the number and amount of claims approved or rejected on appeal by the Board. During 1999, the Board did not approve any claims. The amount of the dismissed claims or inquiries were an approximate total of $1,197,067.59. This total is from Pontiac ($1,112,417.59), Westland ($74,650) and Mecosta (at least $10,000).

Senator A. Smith, under her constitutional right of protest (Art. 4, Sec. 18), protested against the passage of Senate Bill No. 1222.
Senator A. Smith's statement is as follows:
I voted "no" on Senate Bill No. 1222. I know that we have a huge degree of concern in this state about the potential for school violence, but we also have other remedies for school violence. Introducing a concept of a warrantless arrest for a misdemeanor that on occasion speaks to a he said/she said kind of situation really is overkill.
I think it's time for us to look at real causes for violence in schools and real management systems. The peer review process has the potential of being faster and far more effective than a warrantless arrest in the school system that puts children who are supposed to have the guidance of their parents in situations like this at a grave disadvantage. Therefore, I voted "no" on the bill.

A resolution proclaiming May 20-26, 2000, as North American Safe Boating Week in the state of Michigan.
Whereas, The members of the Michigan Senate wish to acknowledge the importance of safe, sober, and responsible boating to the people of our great state by joining in the efforts of National Boaters Against Drunk Driving (BADD), located in the city of Battle Creek, Michigan; and
Whereas, BADD has worked to increase awareness of the importance of knowing and obeying all navigation rules on the water by completion of boating safety training, abstaining from the use of alcohol or drugs while operating a watercraft, and always wearing a life jacket-PFD (personal floatation device) when on board a watercraft; and
Whereas, Support personnel in Calhoun County and statewide are trained in boating safety, which is designed to show how the recreational boating community places emphasis on individual responsibility, education, and respect of all waterways; and
Whereas, Knowledge and skills are brought to bear on reducing human error and improving judgment while using a watercraft; and
Whereas, It is imperative that greater awareness is generated in realizing the impact that adverse decisions such as operating watercraft under the influence of alcohol or drugs or choosing not to wear a life jacket-PFD can have in a community and in our democracy. BADD exists to teach individuals how to practice proper boating safety and to influence others to practice it; and
Whereas, The activities during May 20-26, 2000, will serve to promote the importance of safe boating habits in schools, workplaces, communities, state, and country; now, therefore, be it
Resolved by the Senate, That the efforts of National Boaters Against Drunk Driving (BADD) and its numerous partner organizations are lauded and acknowledged by proclaiming May 20-26, 2000, as North American Boating Safety Week in the state of Michigan; and be it further
Resolved, That a copy of this resolution be transmitted to National Boaters Against Drunk Driving (BADD) in the city of Battle Creek, Michigan, as an expression of our support for this event.
