AN ACT to amend 1949 PA 300, entitled "An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of owners and operators of vehicles and service of process on residents and nonresidents; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date," (MCL 257.1 to 257.923) by adding section 811i.

The People of the State of Michigan enact:

Sec. 811i. (1) The secretary of state shall develop under section 811e and, upon application, may issue under section 811f a state-sponsored water quality fund-raising registration plate and a matching state-sponsored water quality collector plate as provided under section 811g. The plate shall be of a design as determined by the secretary of state after consultation with and advice of the director of the department of environmental quality.

(2) Water quality fund-raising registration plate donations collected under section 811f and matching water quality collector plate fund-raising donations collected under section 811g shall be disbursed under section 811h by the secretary of state to the state treasurer, who shall credit the donation money to the water quality protection fund created under subsection (4).

(3) The department of environmental quality shall establish and administer a "water quality protection fund grant program" and shall set policy and oversee this program. The program shall provide grants to local units of government for the purpose of protecting the water quality of the Michigan great lakes and inland lakes, rivers, and streams. The department of environmental quality may promulgate rules to implement this grant program under the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

(4) The water quality protection fund is created within the state treasury. The state treasurer may receive money or other assets from any source for deposit into the fund. The state treasurer shall direct the investment of the fund. The state treasurer shall credit to the fund interest and earnings from fund investments. Money in the fund at the close of the fiscal year shall remain in the fund and shall not lapse to the general fund. Money from the fund shall be expended, upon appropriation, only for the purpose of protecting the water quality of the Michigan great lakes and inland lakes, rivers, and streams.

(5) For purposes of this chapter:

(a) "Local unit of government" means any of the following:

(i) A county, city, village, or township.

(ii) An agency of a county, city, village, or township.

(iii) The office of a county drain commissioner.

(iv) A soil conservation district established under part 93 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.9301 to 324.9313.

(v) A watershed council established under part 311 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.31101 to 324.31119.

(vi) A local health department as that term is defined in section 1105 of the public health code, 1978 PA 368, MCL 333.1105.

(vii) A community college or junior college established pursuant to section 7 of article VIII of the state constitution of 1963.

(viii) A 4-year institution of higher education, public or private, located in this state.

(ix) An authority or other public body created by or pursuant to state law.

(b) "Water quality fund-raising registration plate" means a registration plate containing a specialized design pertaining to the water quality of this state.

Enacting section 1. This amendatory act takes effect October 1, 2000.

Enacting section 2. This amendatory act does not take effect unless Senate Bill No. 826 of the 90th Legislature is enacted into law.
