AN ACT to make, supplement, and adjust appropriations for capital outlay, the department of agriculture, the department of environmental quality, the department of natural resources, the department of treasury, the department of community health, the department of transportation, and the department of consumer and industry services for the fiscal year ending September 30, 2001; to implement the appropriations within the budgetary process; to provide for the expenditure of appropriations; and to repeal acts and parts of acts.

Sec. 202. The expenditures and funding sources authorized under this act are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

Sec. 203. For the fiscal year ending September 30, 2000, general fund-general purpose unreserved balances at the final close of the fiscal year, not to exceed $62,900,000.00, are appropriated and shall be transferred to the countercyclical budget and economic stabilization fund pursuant to section 354(4) of the management and budget act, 1984 PA 431, MCL 18.1354. If the total state revenues for the fiscal year ending September 30, 2000 have exceeded the revenue limit established under section 26 of article IX of the state constitution of 1963 by less than 1%, the appropriation contained in this section shall be considered a deposit into the countercyclical budget and economic stabilization fund pursuant to provisions of section 26 of article IX of the state constitution of 1963. If the total state revenues for the fiscal year ending September 30, 2000 have exceeded the revenue limit by 1% or more, the appropriation contained in this section shall not take place.

CAPITAL OUTLAY


Sec. 301. The department of natural resources shall require local units of government to enter into agreements with the department for the purpose of administering the natural resources trust fund grants identified in section 102. Among other provisions, the agreements shall require that grant recipients agree to dedicate to public outdoor recreation uses in perpetuity the land acquired or developed; to replace lands converted or lost to other than public outdoor recreation use; and, for parcels acquired that are 5 or more acres in size, to provide the state with a nonparticipating 1/6 minimum royalty interest in any acquired minerals that are retained by the grant recipient. The agreements shall also provide that the full payments of grants can be made only after proof of acquisition, or completion of the development project, is submitted by the grant recipient and all costs are verified by the department of natural resources.

Sec. 302. Any unobligated balance in any natural resources trust fund appropriation made under section 102 shall not revert to the fund from which appropriated at the close of the fiscal year, but shall continue until the purpose for which it was appropriated is completed for a period not to exceed 3 fiscal years. The unexpended balance of any natural resources trust fund appropriation made in section 102 remaining after the purpose for which it was appropriated is completed shall revert to the Michigan natural resources trust fund and be made available for appropriation.

Sec. 303. Of the funds appropriated in section 102, use of more than $4,500,000.00 in natural resources trust fund revenue for the acquisition of land for the Detroit riverfront acquisition project (#00-253) is contingent upon at least $4,000,000.00 in revenue deposited in the natural resources trust fund from the conveyance of land as provided for in section 2 of 1999 PA 232.

Sec. 304. The total project cost for the department of agriculture, animal health diagnostic laboratory authorized under 2000 PA 291 is increased from $45,000,000.00 to not more than $58,000,000.00. The state building authority share is increased from $44,999,900.00 to $57,999,900.00; and general fund/general purpose share remains $100.00.

COMMUNITY HEALTH


Sec. 351. From the funds appropriated in section 104 for lead abatement, up to $600,000.00 shall be used for lead abatement activities statewide, including Wayne County.

ENVIRONMENTAL QUALITY


Sec. 601. (1) In addition to the funds appropriated in part 1 for the environmental cleanup and redevelopment, leaking underground storage tank cleanup, and the contaminated lake and river sediments cleanup programs, the department of environmental quality is authorized to expend amounts remaining from prior fiscal year appropriations to meet funding needs of legislatively approved sites.

(2) Unexpended and unencumbered amounts remaining from appropriations from the environmental protection bond fund contained in 1989 PA 180, 1990 PA 55, 1990 PA 194, 1991 PA 31, 1991 PA 160, 1993 PA 74, 1993 PA 353, 1994 PA442, 1996 PA 353, and 1997 PA 114 are appropriated for expenditure for any site listed in this act and any site listed in the public acts referenced in this section.

(3) Unexpended and unencumbered amounts remaining from appropriations from the cleanup and redevelopment fund and unclaimed bottle deposits fund contained in 1996 PA 319, 1997 PA 113, 1997 PA 114, 1998 PA 292, 1999 PA125, and 2000 PA 275 are appropriated for expenditure for any site listed in this act and any site listed in the public acts referenced in this section.

(4) To the extent authorized under 1998 PA 288, unexpended and unencumbered amounts remaining from appropriations from the clean Michigan initiative fund contained in 1999 PA 111 and 2000 PA 52 are appropriated for expenditure for any site listed in this act and any site listed in the public acts referenced in this section.

Sec. 602. The unexpended portions of the appropriations in part 1 for the department of environmental quality listed in this section are considered work project appropriations. The purpose of these projects is to provide redevelopment and contaminated site cleanup and pollution prevention control to be accomplished through contractual services with an estimated completion date of September 30, 2005. The projects are as follows:

(a) Contaminated lake and river sediments cleanup program (estimated cost $3,980,000.00).

(b) Illicit storm sewer connection grant program (estimated cost $3,000,000.00).

(c) Remedial action plan and lakewide management plan implementation grant program (estimated cost $3,000,000.00).

(d) Conservation reserve enhancement program match (estimated cost $2,000,000.00).

(e) Voluntary storm water permits grants (estimated cost $1,500,000.00).

(f) Failing on-site septic systems (estimated cost $2,000,000.00).

(g) Protecting high quality waters (estimated cost $3,000,000.00).

(h) Nonpoint source pollution prevention and control projects program (estimated cost $7,000,000.00).

Sec. 701. The appropriation in part 1 for local recreation grants shall be allocated and awarded in accordance with part 716 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.71601 to 324.71607.

Sec. 702. The unexpended portion of the appropriation in part 1 for local recreation grants is considered a work project appropriation. The purpose of these grants is to provide funding to local governmental units for local recreation capital improvement projects including the construction, expansion, development, or rehabilitation of recreational facilities. The estimated cost is $14,733,800.00, with an estimated completion date of September 30, 2005.

Sec. 703. The appropriation in part 1 for the snowmobile trail grooming demonstration project shall be provided to the Keweenaw research center, Michigan Technological University, to test and demonstrate the effectiveness of the snowmobile trail groomer developed through the federal rural and community development grant program. This demonstration shall compare the new technology with current grooming methods. A summary report of the effectiveness of this new grooming technology shall be provided to the house and senate appropriation subcommittees on natural resources and the house and senate fiscal agencies on April 30, 2001.

Sec. 704. (1) The director of the department of natural resources shall designate a department deputy director to serve as his or her representative on the steering committee and the planning committee of the Michigan lighthouse project.

(2) The department shall maintain and repair lighthouse structures and improvements for any lighthouse located on department owned or managed property. The department shall not alter the physical appearance, alter or demolish any lighthouse or any structure related to the historic use of the lighthouse property, or negate or alter any improvement made to a lighthouse property where the department has a fee or leasehold interest without first securing the official approval of the state historic preservation officer, Michigan department of state.

TRANSPORTATION


Sec. 749. From the funds appropriated in section 107, the Michigan department of transportation shall cause up to $1,300,000.00 to be expended to perform an intermodal transportation study of the I-69/I-94 corridor. The study shall address the impact of intermodal transportation needs on international trade and economic development within that corridor.

Sec. 750. From funds appropriated in section 107, the Michigan department of transportation shall cause up to $700,000.00 to be expended to perform an intermodal transportation study of the US-131 corridor from Cadillac to the Michigan/Indiana state line. The study shall address the impact of intermodal transportation needs on international trade and economic development within that corridor.

Sec. 751. From the funds appropriated in section 110 of 2000 PA 271, $1,600,000.00 shall be spent for the purposes authorized in section 336 of 2000 PA 271.

TREASURY


Sec. 801. (1) The $10,000,000.00 appropriated in section 111 of 2000 PA 276 is from the tobacco settlement trust fund to fund an incentive program for the Michigan education savings program created under the Michigan education savings program act, 2000 PA 161, MCL 390.1471 to 390.1486.

(2) The funds appropriated for the Michigan education savings program shall be utilized to provide a state match to dollars invested on behalf of each child named as a designated beneficiary in the Michigan education savings program who is 6 years old or less, who is a Michigan resident and whose family's income is $80,000.00 or less.

(3) During fiscal year 2001, the state shall provide $1.00 of matching funds for each $3.00 of individual contributions to the educational savings accounts. The maximum state match for each designated beneficiary shall be $200.00.

(4) The state match shall be available only in the first year the child is enrolled in the Michigan education savings program.

Sec. 802. (1) Section 960 of 2000 PA 276 is repealed.

(2) Section 1695 of 2000 PA 296 is repealed.

(3) Section 212 of 2000 PA 291 is repealed.
