Rev. Donald Kevern, Support Minister of Clarkston United Methodist Church in Clarkston, offered the following invocation:

 

"Loving, supportive, and nurturing God, we give thanks this day for the opportunity to share this world, this country, and this state which has been presented to us. We stand awed by the beauty of Michigan and by the care with which our forefathers touched its sacred boundaries. Indeed we find here the richness of soil, the blessings of many lakes, and air that is still safe to breathe. We recognize this day the awesome responsibility that has been given to us by You, O God, and by those persons who have chosen us, their legislator, to lead them into the future. Though we are partisan in politics, let us be unified in knowing what is best for the people who have chosen us to represent them. Let us be fully aware of the trust that has been placed in us. May that trust be demonstrated not only in each session of the Legislature, but also in the ways in which we conduct our business and our lives. Let us keep our heads when all about us seems chaotic. Let us never be so proud that we cannot fall to our knees and bow our heads to ask what You would have us do. Let us find in Your presence that peace that allows for good decisions, honest policy and fair judgment. Chastise us when we allow the sin of arrogance to stand in the way of productivity. Push us when we feel that we are already exhausted by the work that stands in front of us. Let us understand the glory of giving and the humility of receiving. Let us be a positive example for the children of this state so that they may find in us an inspiration to lead in the future. Remind us constantly of the charge that has been given to us. Let us find no peace in practices that would take us away from what You would have us be. Let our roads be paved with the goodness of heart, the joy of service, and the desire to do the best for all. Let us strive for equality among the people. Let us reach out to those in need. Let us bring food to the poor, clothing to the naked, and peace to those imprisoned by lives that are submerged by the pain of poverty and hunger. In times of darkness and despair, let us light the candle of promise and hope. Let us be known as Godly people, men and women who in their ability to touch the lives of others, have indeed been touched by the hand of God. In the name of the God of us all, we pray. Amen."

Rep. Lemmons, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill 4448 for the following reasons: As the current law stands in the wake of the Michigan Supreme Court decision in Yaldo v. North Pointe Insurance Company, Section 6013(5) of the Revised Judicature Act benefits consumers and should not be changed. The existing law provides insurance companies with an added financial incentive to pay valid claims, rather than to force their customers to sue to receive payment on a claim. House Bill 4448 will change the law to provide a financial benefit to insurance companies, not the people."

Senate Bill No. 230, entitled

A bill to make appropriations for the department of agriculture for the fiscal year ending September 30, 2002; to provide for the expenditure of the appropriations; to create funds; to provide for the imposition of fees; to require reports, audits, and plans; to authorize certain transfers by certain state agencies; and to provide for the disposition of fees and other income received by certain state agencies.

Was read a second time, and the question being on the adoption of the proposed substitute (H-1) previously recommended by the Committee on Appropriations,

The substitute (H-1) was adopted, a majority of the members serving voting therefor.

 

Rep. Pumford moved to amend the bill as follows:

1. Amend page 20, line 12, after "404." by inserting "(1)".

2. Amend page 20, following line 17, by inserting:

"(2) Funds appropriated in subsection (1) shall also be expended to locate milk vending machines in the Chippewa Hills school district, McBain Rural Agricultural school district, Pine River area schools, and Cadillac area schools. The department shall work with administrators at the schools to facilitate the location of the milk vending machines in their respective school buildings.".

Rep. Ehardt moved to amend the bill as follows:

1. Amend page 2, following line 23, by inserting:

"Value-added processing grant: sugar beets 100"

1. Amend page 29, following line 18, by inserting:

"Sec. 816. From the appropriations in part 1, the department may implement a competitive horse show grant program.".

Rep. Frank moved to amend the bill as follows:

1. Amend page 29, following line 18, by inserting:

"Sec. 816. From the appropriations for premiums, county and state fairs in section 110, $50,000.00 shall be awarded to licensed race meet operators for promotions, capital improvements, or operations at race meets which are conducted on facilities leased from county fairs.".

The motion did not prevail and the amendment was not adopted, a majority of the members serving not voting therefor.

 

Rep. Julian moved to amend the bill as follows:

1. Amend page 24, line 14, by striking out all of lines 14 through 16 and inserting:

"Sec. 703. (1) The $100,000.00 appropriated in section 109 for the grown in Michigan program is to provide competitive grants to Michigan nonprofit organizations to raise in-state consumer awareness of Michigan grown commodities.

(2) The grants are to be made by the Michigan commission of agriculture on a competitive basis considering the following order of priority:

(a) Cooperative efforts by recognized, statewide, grower-funded organizations.

(b) The number of consumers made aware of the benefits of Michigan grown commodities.

(c) The number of Michigan grown products encompassed in the proposal.

(d) The amount of the match.

(3) A grant made under this section shall not be less than $5,000.00 or more than $25,000.00.

(4) Each grant shall be matched equally with grantees' funds. In-kind contributions shall not be considered as matching funds.

(5) The Michigan commission of agriculture shall report to the house and senate appropriations subcommittees on agriculture and the house and senate fiscal agencies 10 days prior to making a grant under this section.".

1. Amend page 15, following line 13, by inserting:

"Sec. 321. To enable the legislature to evaluate the most effective use of state appropriations for court diversion programs known as drug treatment courts and mental health treatment courts, the state court administrators office shall investigate the cost, and the benefits of diversion programs. The state court administrators shall solicit testimony from members of the public, the judiciary, the state bar, mental health and substance abuse services consumers, mental health and substance abuse service providers and recommend whether further appropriations shall be made for diversion programs. The state court administrators office shall provide an estimated cost avoidance for diversion programs and report to the members of the house and senate appropriations committees, the house and senate fiscal agencies and the state budget director no later than February 15, 2002.".

A resolution honoring the Michigan Land Title Association upon the occasion of their 100th anniversary and designating July 23, 2001, as Michigan Land Title Day.

Whereas, It is with deep appreciation of the significance of this milestone that we commend the members of the Michigan Land Title Association as they mark the 100th anniversary of the founding of their exemplary organization. We are proud to recognize the important role that this enterprise has played in contributing to both the economic well-being of Michigan and the lives of countless citizens; and

Whereas, Since its founding in 1901, the Michigan Land Title Association has become a vital element in helping to protect Michigan's public by providing valuable land title insurance. This long and successful practice protects home buyers and real estate investors by offering protection against defects in land titles and provides stability in the real estate economy; and

Whereas, In looking back over Michigan Land Title Association's 100-year history, it is clear that this organization has set its course with a continuing look towards the future. The Michigan Land Title Association has sustained itself through dedication and innovation; and

Whereas, While the changing times dictate many of the decisions for any good organization, Michigan Land Title Association has also demonstrated the importance of looking to include the ideas of its members and the role they play in the community in making successful choices. We are grateful for all that Michigan Land Title Association has contributed to all of Michigan; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body honor the 100th anniversary of the Michigan Land Title Association and designate July 23, 2001, as Michigan Land Title Day. We salute them on this happy occasion and wish them well in the years to come; and be it further
