Rev. Robert L. Moss, Pastor of First Church of God, in St. Joseph offered the following invocation:

 

"Heavenly Father, we give You thanks for this day and for each man and woman gathered here as servants of the people of our great state. There are so many blessings to thank You for as You have poured Your abundance upon us in Michigan. So we pause just now to give You our heartfelt thanks.

I especially pray for the men and women who have committed their energies to serve as legislators in our state. I lift them up to You in accordance to the promise given in Holy Scripture in James 1: "if you need wisdom--if you want to know what God wants you to do--ask Him, and He will gladly tell You. He will not resent your asking." (James 1:5 New Living Translation)

So we come to You today, Father, seeking that gift of Divine wisdom for the people gathered in this place. The decisions placed before them are seldom easy. Many voices press conflicting expectations upon each of them. That is why wisdom from above is needed.

We pray that today You will bestow that wisdom upon these legislators, as they seek to do what is right, even as much as they seek to do what is helpful for their constituents.

Father, we must also admit the weakness of our own humanity to You. When we are experiencing prosperity, we fail to thank You as we ought. And, when tough times come, we complain far more than we should. Forgive us, Lord, for failing to keep our eyes upon You in times of abundance as well as in the days of our greatest challenges.

So today we pray not only for those gathered in this room, but for all the citizens of Michigan. Bless those in the factories and on the farms. Give insight to those who serve in the hospitals and universities. Give encouragement to those in business, industry and commerce. Bless our families, our cities, our towns and villages.

Help us, Lord, to heal the breaches that divide us. Help our leaders to guide us in reaching across the racial divide, across cultural misunderstanding, across religious prejudices, and beyond the gaps of misunderstanding caused by our own limited imagination.

Finally, Lord, help each of us to remember to give You thanks every day as we depend upon You as our source and guide. We pray this in Your Holy name. Amen."

A bill to amend 1953 PA 232, entitled "An act to revise, consolidate, and codify the laws relating to probationers and probation officers, to pardons, reprieves, commutations, and paroles, to the administration of correctional institutions, correctional farms, and probation recovery camps, to prisoner labor and correctional industries, and to the supervision and inspection of local jails and houses of correction; to provide for the siting of correctional facilities; to create a state department of corrections, and to prescribe its powers and duties; to provide for the transfer to and vesting in said department of powers and duties vested by law in certain other state boards, commissions, and officers, and to abolish certain boards, commissions, and offices the powers and duties of which are transferred by this act; to allow for the operation of certain facilities by private entities; to prescribe the powers and duties of certain other state departments and agencies; to provide for the creation of a local lockup advisory board; to prescribe penalties for the violation of the provisions of this act; to make certain appropriations; to repeal certain parts of this act on specific dates; and to repeal all acts and parts of acts inconsistent with the provisions of this act," by amending section 65 (MCL 791.265), as amended by 1998 PA 512.

A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 11104, 11108, 11130, 11135, 12101, 12102, 12103, 12109, and 12112 (MCL 324.11104, 324.11108, 324.11130, 324.11135, 324.12101, 324.12102, 324.12103, 324.12109, and 324.12112), sections 11104 and 11130 as amended by 1998 PA 139 and sections 12101, 12102, 12103, and 12109 as amended by 1998 PA 140, and by adding section 11153.

Reps. Basham and Patterson moved to amend the bill as follows:

1. Amend page 9, following line 12, by inserting:

"SEC. 11108A. (1) EXCEPT AS PROVIDED IN SUBSECTION (2), A MUNICIPALITY MAY IMPOSE AN IMPACT FEE OF NOT MORE THAN 5 CENTS PER GALLON ON HAZARDOUS WASTE THAT IS DISPOSED OF IN A MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL LOCATED WITHIN THE MUNICIPALITY. HOWEVER, IF THE MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL IS LOCATED WITHIN A VILLAGE, THE IMPACT FEE PROVIDED FOR IN THIS SUBSECTION SHALL BE IMPOSED BY THE TOWNSHIP IN AGREEMENT WITH THE VILLAGE. THE IMPACT FEE SHALL BE ASSESSED UNIFORMLY ON ALL HAZARDOUS WASTE ACCEPTED FOR DISPOSAL.

(2) A MUNICIPALITY MAY ENTER INTO AN AGREEMENT WITH THE OWNER OR OPERATOR OF A MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL TO ESTABLISH A HIGHER IMPACT FEE THAN THE IMPACT FEE PROVIDED FOR IN SUBSECTION (1).

(3) THE IMPACT FEE IMPOSED UNDER THIS SECTION SHALL BE COLLECTED BY THE OWNER OR OPERATOR OF A MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL AND SHALL BE PAID TO THE MUNICIPALITY QUARTERLY BY THE THIRTIETH DAY AFTER THE END OF EACH CALENDAR QUARTER. HOWEVER, THE IMPACT FEE ALLOWED TO BE ASSESSED TO EACH MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL UNDER THIS SECTION SHALL BE REDUCED BY ANY AMOUNT OF REVENUE PAID TO OR AVAILABLE TO THE MUNICIPALITY FROM THE MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL UNDER THE TERMS OF ANY PREEXISTING AGREEMENTS, INCLUDING, BUT NOT LIMITED TO, CONTRACTS, SPECIAL USE PERMIT CONDITIONS, COURT SETTLEMENT AGREEMENT CONDITIONS, AND TRUSTS.

(4) UNLESS A TRUST FUND IS ESTABLISHED BY A MUNICIPALITY PURSUANT TO SUBSECTION (5), THE REVENUE COLLECTED BY A MUNICIPALITY UNDER SUBSECTION (1) SHALL BE DEPOSITED IN ITS GENERAL FUND TO BE USED FOR ANY PURPOSE THAT PROMOTES THE PUBLIC HEALTH, SAFETY, OR WELFARE OF THE CITIZENS OF THE MUNICIPALITY. HOWEVER, REVENUE COLLECTED PURSUANT TO THIS SECTION SHALL NOT BE USED TO BRING OR SUPPORT A LAWSUIT OR OTHER LEGAL ACTION AGAINST AN OWNER OR OPERATOR OF A MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL WHO IS COLLECTING AN IMPACT FEE PURSUANT TO SUBSECTION (3) UNLESS THE OWNER OR OPERATOR OF THE MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL HAS INSTITUTED A LAWSUIT OR OTHER LEGAL ACTION AGAINST THE MUNICIPALITY.

(5) THE MUNICIPALITY MAY ESTABLISH A TRUST FUND TO RECEIVE REVENUE COLLECTED PURSUANT TO THIS SECTION. THE TRUST FUND SHALL BE ADMINISTERED BY A BOARD OF TRUSTEES. THE BOARD OF TRUSTEES SHALL CONSIST OF THE FOLLOWING MEMBERS:

(A) THE CHIEF ELECTED OFFICIAL OF THE MUNICIPALITY CREATING THE TRUST FUND.

(B) AN INDIVIDUAL FROM THE MUNICIPALITY APPOINTED BY THE GOVERNING BOARD OF THE MUNICIPALITY.

(C) AN INDIVIDUAL APPROVED BY THE OWNERS OR OPERATORS OF THE MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELLS WITHIN THE MUNICIPALITY AND APPOINTED BY THE GOVERNING BOARD OF THE MUNICIPALITY.

(6) INDIVIDUALS APPOINTED TO SERVE ON THE BOARD OF TRUSTEES UNDER SUBSECTION (5) (B) AND (C) SHALL SERVE FOR TERMS OF 2 YEARS.

(7) MONEY IN THE TRUST FUND MAY BE EXPENDED, PURSUANT TO A MAJORITY VOTE OF THE BOARD OF TRUSTEES, FOR ANY PURPOSE THAT PROMOTES THE PUBLIC HEALTH, SAFETY, OR WELFARE OF THE CITIZENS OF THE MUNICIPALITY. HOWEVER, REVENUE COLLECTED PURSUANT TO THIS SECTION SHALL NOT BE USED TO BRING OR SUPPORT A LAWSUIT OR OTHER LEGAL ACTION AGAINST AN OWNER OR OPERATOR OF A MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL WHO IS COLLECTING AN IMPACT FEE PURSUANT TO SUBSECTION (3) UNLESS THE OWNER OR OPERATOR OF THE MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL HAS INSTITUTED A LAWSUIT OR OTHER LEGAL ACTION AGAINST THE MUNICIPALITY.

(8) AS USED IN THIS SECTION, "MULTISOURCE COMMERCIAL HAZARDOUS WASTE DISPOSAL WELL" MEANS THAT TERM AS IT IS DEFINED IN SECTION 62506A.".

A resolution honoring Bruce Montroy as he retires as President of the Michigan Propane Gas Association.

Whereas, It is a pleasure to join with the family, friends, and colleagues of Bruce Montroy in extending our best wishes upon the occasion of his retirement as President of the Michigan Propane Gas Association. At this milestone in his life, we are proud to recognize all that Bruce Montroy has accomplished, not only throughout his association with Michigan Propane Gas Association, but also in all other aspects of his life; and

Whereas, Over the course of Bruce Montroy's long and productive service with Michigan Propane Gas Association, both as a member and as president, he has contributed to its growth and to the reputation it has developed during this period. In this, Bruce Montroy's personal sense of dedication, integrity, and thoroughness have proven invaluable. His colleagues have come to depend upon this consistency in meeting each task with a positive attitude; and

Whereas, Bruce Montroy is a second-generation gasser with 31 years of experience in the propane industry. He currently serves as the Director of Outside Sales for Bergquist, Inc. An active member of the National Propane Gas Association, Bruce participates in a variety of educational and safety training programs and serves as a CETP instructor throughout the Midwest; and

Whereas, With Bruce Montroy's years of experience, the people who have come to rely upon this enterprise have benefitted enormously. In the months and years to come, the example that Bruce Montroy set in all facets of his career will continue to be of value; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body honor Bruce Montroy as he embarks upon the more leisurely pursuits of retirement. May the future be filled with ample time to enjoy life and the love of family and friends; and be it further

Resolved, That a copy of this resolution be transmitted to Bruce Montroy and his wife Jeanne as a token of our esteem.

A bill to provide for the establishment of alternative agricultural production districts in local governmental units; to provide for the exemption from certain taxes; to levy and collect a specific tax upon the owners of agricultural property; to provide for the disposition of the tax; to provide for the obtaining and transferring of an exemption certificate and to prescribe the contents of those certificates; to prescribe the powers and duties of the state tax commission and certain officers of local governmental units; and to provide penalties.

With the recommendation that substitute (H-2) previously recommended by the Committee on Agriculture and Resource Management not be adopted.

The committee further recommended that the substitute (H-4) be adopted and that the bill then pass.

The bill and substitutes were referred to the order of Second Reading of Bills.
