A SUMMARY OF HOUSE BILL 4446 AS INTRODUCED 3-8-01

House Bill 4446 would add a new part to the Natural Resources and Environmental Protection Act to prohibit the sale, offering for sale, or offering for promotional purposes of candlewicks that contain lead or a lead compound or a candle that has such a candlewick. The prohibition would take effect one year after the act's effective date. Beginning 60 days after the act's effective date, a person could not sell, offer for sale, or offer for promotional purposes a candle with a candlewick that contains lead or a lead compound unless the candle was clearly labeled with a warning of the candlewick's contents. A person who violated the bill's provisions would be guilty of a misdemeanor punishable by imprisonment for up to 60 days or a fine of up to $1,000, or both; the person would also have to pay the costs of prosecution.
