A SUMMARY OF HOUSE BILL 4449 AS INTRODUCED 3-8-01
The bill would amend the Michigan Penal Code to allow a court to require a person convicted of assault, assault and battery, or domestic assault or assault and battery to pay the medical expenses, including a physical examination that was performed for evidentiary purposes, that were incurred by the victim of the assault. Payment of the medical expenses of the victim would be in addition to fines and imprisonment currently imposed under the code.
Further, the Penal Code prohibits a person from intentionally making a false report of the commission of a crime to a member of the Michigan State Police, a sheriff or deputy sheriff, a local police officer, or any other peace officer, knowing the report to be false. A violation results in a misdemeanor or felony with a penalty of a fine, imprisonment, or both. The bill would add that if a false report related to a domestic violence assault or assault and battery, the court would have to require the person to reimburse the individual who had been falsely accused for the cost of defending against the false accusation.
