A SUMMARY OF HOUSE BILL 4997 AS INTRODUCED 6-28-01

The Worker's Disability Compensation Act construes "personal injury" to include respiratory and heart diseases or resulting illnesses, and considers such diseases or illnesses as arising out of and in the course of employment in the absence of evidence to the contrary (and thus compensable under the act). This provision currently applies to members of "full paid" fire departments of an airport run by county road commissions in counties of one million or more people or by state universities or colleges. It also applies to members of full paid fire or police departments of a city, township, or incorporated village, if the member is employed and compensated upon a full time basis; county sheriffs and deputies; members of the state police; conservation officers; and Michigan Public Service Commission motor carrier inspectors.

The bill would amend the act to add volunteer city, township, or (incorporated) village firefighters to the act's provisions regarding compensation for job-related respiratory or heart diseases or resulting illnesses. It would also specify that those provisions applied to a member of a fully paid fire department of an airport run by any county, by a public airport authority, or by a state university or college. Finally, the provisions would apply to officers of the Motor Carrier Enforcement Division of the Department of State Police rather than motor carrier inspectors of the Michigan Public Service Commission.
