A SUMMARY OF HOUSE BILL 5026 AS INTRODUCED 7-11-01

The Michigan Penal Code prohibits the carrying of a pistol in a vehicle without a concealed weapons license (CCW), but allows a few exemptions. A person is allowed to carry an unloaded antique firearm in a wrapper or container in the trunk of a vehicle while en route to or from a hunting or target shooting area, or a function that involves the exhibition, demonstration, or sale of antique firearms. Similarly, a person may also carry an unloaded pistol in a wrapper or container in the trunk of his or her vehicle while en route to or from a hunting or target shooting area if he or she possesses a valid Michigan hunting license or proof of valid membership in an organization that has a pistol shooting range facility. A person may also carry an unloaded pistol in a wrapper or container in his or her trunk from the place of purchase to his or her home or work place, to a repair shop, or to a new residence or a new work site while in the process of moving to the new home or new job.

House Bill 5026 would amend the Michigan Penal Code to remove these restrictions and instead allow a person to carry an unloaded pistol or unloaded antique firearm without a concealed weapon license (CCW) if the pistol or antique gun was carried in the trunk of a vehicle and was in a wrapper or container.
