A SUMMARY OF HOUSE BILL 5045 AS INTRODUCED 9-20-01
Currently, the Michigan Vehicle Code makes it a felony offense for a person to make a false certification to a matter or thing required by the terms of the code to be certified, including, but not limited to, an application for any type of driver license, dealer license, vehicle certificate of title, vehicle registration, vehicle inspection, self-insurance, or commercial driver training school. A person convicted of a second or subsequent violation faces enhanced penalties.
The bill would amend the code to require the element of intent. Under the bill, a person would have to make such a false certification to a matter or thing "with intent to use the false certification". Also, the bill would specify that use of the false certification would be presumptive evidence of intent. Further, the bill would specify that this provision of law would not apply unless the matter or thing falsely certified was used by the individual who made the false certification.
