A SUMMARY OF HOUSE BILL 5046 AS INTRODUCED 9-20-01
The bill would amend the Management and Budget Act to require the Department of Management and Budget to require that each contract entered into for construction or repair of state property contain a clause prohibiting project labor agreements. In addition, a local unit of government that receives state funds for a construction or repair project would also be required to include such a clause in its contract for the work, as a condition of receiving state funds. The contract clause required under the bill would have to specify that persons working on a project employed by a contractor or subcontractor would not be required to become a member of or be affiliated with a labor organization as a condition of working on the project, nor to pay dues or fees to a labor organization, in excess of the employee's share of labor organization costs relating to collective bargaining, contract administration, or grievance adjustment, as a condition of working on the project.
