A SUMMARY OF HOUSE BILL 5077 AS INTRODUCED 9-20-01

Public Act 480 of 1996 authorized the state administrative board to convey certain state-owned property in Kalamazoo to the Kalamazoo Community Mental Health Services Program for consideration of $1. The conveyance, which consisted of several buildings on the campus of the Kalamazoo Psychiatric Hospital, was accomplished by quitclaim deed approved by the attorney general.

House Bill 5077 would amend Public Act 480 of 1996 to require that the quitclaim deed entered into on January 26, 1998 to accomplish the conveyance be amended to allow the Kalamazoo Community Mental Health Services Program to sell a portion of the previously state-owned property at fair market value without violating the restriction contained in the deed requiring the property to be used exclusively for public purposes. The bill would require that the fair market value of the property be determined by an appraisal based on the property's highest and best use, as prepared by the state tax commission or an independent appraiser. The proceeds from the sale would be retained by Kalamazoo Community Mental Health Services and could be used only to provide housing to developmentally disabled, mentally ill, or at-risk families within that service area.
