WAIVE REPLACEMENT LICENSE PLATE FEE FOR STOLEN VEHICLE

A SUMMARY OF HOUSE BILL 5078 AS INTRODUCED 9-20-01
Currently under the law, when a peace officer detains the driver of a vehicle for a violation of the law for which vehicle immobilization is required, he or she must do all of the following:
-immediately confiscate the vehicle's registration plate and destroy it;
-issue a temporary vehicle registration plate for the vehicle in a manner prescribed by the secretary of state;
-place the temporary plate on the vehicle; and,
-notify the secretary of state through the law enforcement information network (LEIN) that the plate has been confiscated and destroyed, and that a temporary plate has been issued. The law also specifies that the temporary registration plate is valid until the charges against the person are dismissed, the person pleads guilty or nolo contendere to the charges, or the person is found guilty of or is acquitted of the charges.
House Bill 5078 would retain these provisions but specify that the owner of a vehicle that was stolen by a person detained for a violation of the law in which vehicle immobilization was required could acquire a replacement plate for the vehicle immediately upon submitting a copy of the police report to the secretary of state, if that police report indicated the vehicle had been stolen at the time it was detained by the police officer. Further, the bill specifies that the fee for the replacement plate would be waived.
