A SUMMARY OF HOUSE BILL 5129 AS INTRODUCED 10-2-01
House Bill 5129 would amend the Probate Code to allow for a new birth certificate issued at the request of a child's birth parent when the child is adopted by his or her stepparent to identify both birth parents and the adoptive stepparent, in instances when the child's other birth parent is deceased.
Under current law, if a child placing agency, a court, or the Department of Community Health provides an adoptee with the name of one of the adoptee's former parents, upon notification, the department is required to ensure that the original birth certificate on file for the adoptee has been sealed and that a new birth certificate has been prepared and does not refer to an adoption. Under the bill, this provision would not apply if a new birth certificate was issued under the bill's provisions, or if the state registrar was requested to not establish a new birth certificate, by the court, the adoptive parent, or the adoptee (if an adult).
