A SUMMARY OF HOUSE BILL 5345 AS INTRODUCED 10-29-01

Under the Support and Parenting Time Enforcement Act, a court may order child support of a child after he or she reaches 18 years of age, in certain instances. House Bill 5345 would allow a court to extend child support payments beyond the eligible child's 18th birthday if the support payments were reduced or suspended because the payer was incarcerated. Under the bill, the payments would be extended for a time equal to the length of incarceration. The extended period would begin on the child's 18th birthday or the date the payer is released from incarceration, whichever is later. The child support payments would be the lesser of the amount at the time it was suspended or the amount by which it was reduced.
