A SUMMARY OF HOUSE BILL 5349 AS INTRODUCED 10-29-01

Under the Freedom of Information Act, public records are subject to public disclosure unless they are specifically exempted under the act. House Bill 5349 would add to the list of records that are exempt from disclosure information about a public body's "critical infrastructure", which would be defined to mean a system that if incapacitated or destroyed would have a debilitating impact on the defense or economic security of the state and cause harm to the public health or welfare. "Critical infrastructure" would include, but would not be limited to, telecommunications systems, electrical power systems, gas, oil, and water supply systems, banking and finance, transportation, government services, and emergency services.
